【摘要】：人事任免聽(tīng)證制度在西方國(guó)家歷史悠久，而在我國(guó)的理論與實(shí)踐研究方面尚處探索階段。隨著我國(guó)民主法治的發(fā)展，公民參政議政能力的提高，國(guó)家公權(quán)力的行使也日趨透明化、法制化，這為人大人事任免權(quán)的行使提出了更高的要求。人事任免聽(tīng)證制度的構(gòu)建正是契合了這樣的發(fā)展需求與趨勢(shì)。本文首先從聽(tīng)證的由來(lái)說(shuō)起，介紹西方代議制國(guó)家人事任免聽(tīng)證的含義與特征，從而界定我國(guó)人大人事任免聽(tīng)證制度的涵義。其次，從民主憲政、人大任免權(quán)威、官員的素質(zhì)、擬任免人員權(quán)利四大方面論述了人大人事任免聽(tīng)證制度構(gòu)建的意義。再次，重點(diǎn)考察美國(guó)、韓國(guó)、我國(guó)臺(tái)灣地區(qū)的人事任免聽(tīng)證經(jīng)驗(yàn)。最后，圍繞人事任免聽(tīng)證的范圍、主體、程序、結(jié)果等方面，，闡述我國(guó)人大人事任免聽(tīng)證制度構(gòu)建的內(nèi)容，并提出可操作的聽(tīng)證規(guī)程。
[Abstract]:The system of personnel appointment and removal hearing has a long history in western countries, but in our country's theoretical and practical research is still in the exploration stage. With the development of democracy and rule of law in China, citizens' ability to participate in political affairs has been improved. The exercise of national public power is becoming more transparent and legalized. This puts forward higher requirements for the people's Congress to exercise the power of appointment and removal. The construction of the personnel appointment and removal hearing system is in line with such development needs and trends. Firstly, this paper begins with the origin of the hearing. This paper introduces the meaning and characteristics of the hearing of appointment and removal of personnel in the representative system of western countries, so as to define the meaning of the hearing system of appointment and removal of personnel of the people's Congress of our country. This paper discusses the significance of the construction of the personnel appointment and removal hearing system in the people's Congress. Thirdly, it focuses on the experience of the personnel appointment and removal hearing in the United States, South Korea and Taiwan. Finally. Based on the scope, subject, procedure and result of the personnel appointment and removal hearing, this paper expounds the contents of the construction of the personnel appointment and removal hearing system of the National people's Congress of our country, and puts forward the operable hearing rules.
