論當(dāng)代中國(guó)法治人文精神的缺失及建構(gòu)

【摘要】:改革開放三十余年來,我國(guó)的法治建設(shè)在法治理論研究、法律制度的建設(shè)等方面均取得了累累碩果,但在這個(gè)過程中也出現(xiàn)了諸多的問題亟待解決,究其根源我們發(fā)現(xiàn)這些問題的癥結(jié)在于我國(guó)當(dāng)代法治人文精神的缺失。 法治的目的在于保護(hù)人的權(quán)利,而法的實(shí)施與法治的實(shí)現(xiàn)終究又離不開主體人,所以法治的內(nèi)在要求決定了法治建設(shè)中一切從人出發(fā),以人為本,把人的價(jià)值、自由、尊嚴(yán)、幸福和全面發(fā)展作為一種終極關(guān)懷。黨在十六屆三中全會(huì)上提出了“以人為本”的發(fā)展觀,為我國(guó)的法治建設(shè)指明了方向,但由于我國(guó)缺少人文精神的文化土壤、沒有對(duì)法治形成信仰等原因,嚴(yán)重阻礙了我國(guó)“以人為本”法治觀在法治建設(shè)中充分發(fā)揮其積極作用。因此,無(wú)論是從法治理論內(nèi)在要求方面,還是從法治建設(shè)的實(shí)踐方面,法治人文精神的構(gòu)建都成為我國(guó)法治建設(shè)的當(dāng)務(wù)之急。 本文第一部分首先從中西方人文精神涵義入手,接著論述了人文精神的歷史發(fā)展,簡(jiǎn)單分析了中西方人文精神的差異,然后提出了當(dāng)代人文精神的科學(xué)涵義,最后對(duì)法治的人文精神作了界定,提出法治人文精神應(yīng)涵蓋的具體內(nèi)容。 第二部分在了解了法治人文精神理論的基礎(chǔ)上,闡述了我國(guó)當(dāng)代法治人文精神的提出和發(fā)展軌跡,對(duì)我國(guó)當(dāng)代法治人文精神在制度建設(shè)中所取得的成績(jī)予以肯定。 第三部分結(jié)合我國(guó)當(dāng)代法治建設(shè)的實(shí)際,分析我國(guó)法治人文精神的缺失并深刻地剖析其內(nèi)在原因,使人們對(duì)我國(guó)當(dāng)代法治人文精神問題有一個(gè)客觀的認(rèn)識(shí)。 第四部分在客觀認(rèn)識(shí)當(dāng)代中國(guó)法治人文精神問題的基礎(chǔ)上,提出將“以人為本”作為構(gòu)建中國(guó)當(dāng)代法治人文精神的指導(dǎo)思想,在制度建設(shè)上以人文精神為終極目標(biāo),培育法律文化,培養(yǎng)法律信仰,提高民眾的權(quán)利意識(shí),建立權(quán)力制約機(jī)制,加強(qiáng)權(quán)力監(jiān)督,防止權(quán)力異化。 本文試圖對(duì)法治人文精神進(jìn)行系統(tǒng)探究,筆者希望更多地引起大家對(duì)我國(guó)當(dāng)代法治人文精神問題的關(guān)注,也奢望能對(duì)我國(guó)法治發(fā)展起到一定的啟示作用。
[Abstract]:Since the reform and opening up to the outside world for more than 30 years, the construction of the rule of law in our country has made a lot of achievements in the theoretical research of the rule of law and the construction of the legal system, but in this process, there are also many problems to be solved. We find that the crux of these problems lies in the lack of humanistic spirit of contemporary rule of law in our country. The purpose of the rule of law is to protect the human rights, and the implementation of the law and the realization of the rule of law can not be separated from the subject, so the inherent requirements of the rule of law determine all the construction of the rule of law from the people, people-oriented. Regard human value, freedom, dignity, happiness and all-round development as a kind of ultimate concern. At the third Plenary session of the 16 CPC Central Committee, the Party put forward the "people-oriented" concept of development, pointing out the direction for the construction of the rule of law in our country. However, due to the lack of cultural soil of humanistic spirit and the lack of belief in the rule of law and other reasons, the "people-oriented" concept of the rule of law in our country has seriously hindered the full play of its positive role in the construction of the rule of law. Whether from the internal requirements of the theory of the rule of law or from the practice of the construction of the rule of law, the construction of the humanistic spirit of the rule of law has become the top priority of the construction of the rule of law in our country. The first part of this paper begins with the meaning of Chinese and Western humanistic spirit, then discusses the historical development of humanistic spirit, analyzes the differences between Chinese and western humanistic spirit, and then puts forward the scientific meaning of contemporary humanistic spirit. Finally, the humanistic spirit of the rule of law is defined, and the concrete contents that should be covered by the humanistic spirit of the rule of law are put forward. The second part on the basis of understanding the humanistic spirit of the rule of law theory, elaborated the humanistic spirit of contemporary rule of law in China and the development of the track. This paper affirms the achievements of the humanistic spirit of the rule of law in the construction of the system. The third part combines the reality of the construction of our country's contemporary rule of law, analyzes the deficiency of the humanism spirit of our country's rule of law and deeply analyzes its internal reasons, so that people have an objective understanding of the humanistic spirit of our country's contemporary rule of law. On the basis of the objective understanding of the humanistic spirit of the rule of law in contemporary China, the 4th part puts forward the idea of "people-oriented" as the guiding ideology for the construction of the humanistic spirit of the contemporary Chinese rule of law. In system construction, humanistic spirit is the ultimate goal, legal culture is cultivated, legal belief is cultivated, people's right consciousness is raised, power restriction mechanism is established, power supervision is strengthened, power alienation is prevented. This paper attempts to systematically explore the humanistic spirit of the rule of law. The author hopes to arouse more attention to the humanistic spirit of the rule of law in our country, and hope that it will give some enlightenment to the development of the rule of law in our country.
