【摘要】： 政府信息公開即是行政機(jī)關(guān)和其他有關(guān)機(jī)構(gòu)有義務(wù)將在行使國家行政管理權(quán)過程中取得的與行政事務(wù)有關(guān)的文書資料等信息主動或應(yīng)請求向社會公眾公開的制度。從另一角度來說,政府信息公開就是指政府的一切行政活動,除法律另有規(guī)定的以外,一律公開。當(dāng)下中國正處于經(jīng)濟(jì)和社會轉(zhuǎn)型期,建立健全信息公開制度是保障公民人民主權(quán)、參與權(quán)和對政府的監(jiān)督權(quán)的重要途徑,從不同的角度分析,信息公開對民主、法制的建設(shè)以及公民權(quán)利的保障和提高政府機(jī)關(guān)行政效率都具有重大的意義。雖然近年來,我國的政府信息公開制度建設(shè)取得了一定的進(jìn)展,但與現(xiàn)實的需求相比,仍存在許多問題。因此,探討我國政府信息公開制度,具有一定的理論和現(xiàn)實意義。 本文在對當(dāng)今世界主要國家的信息公開法制進(jìn)行比較研究和對我國政府信息公開的實踐進(jìn)行分析的基礎(chǔ)上,對政府信息公開從概念上、理念上、制度上進(jìn)行了初步分析。全文共分三章:一、政府信息公開制度的基本理論。本章對政府信息公開的概念進(jìn)行了辨析,探討了政府信息公開的理論基礎(chǔ),總結(jié)了建立政府信息公開制度的意義。二、通過對國外信息公開立法研究和我國政府信息公開現(xiàn)狀的對比,以求借鑒。三、以我國最新施行的《政府信息公開條例》為切入點,探討如何進(jìn)一步完善我國的政府信息公開法律制度。
[Abstract]:Government information disclosure is the administrative organs and other relevant institutions have an obligation and administrative affairs related documents and other information initiative or request, open to the public system in the exercise of state administration right. Chinese moment is in the economic and social transition, establish and improve the information disclosure system is to protect the citizens of the people's sovereignty, the right to participate in an important way and the government's supervision and analysis from different angles, the information disclosure of democracy, are of great significance to the construction of legal system and the protection of civil rights and to improve the efficiency of the administration. Although in recent years, the construction of government information publicity system in China has made some progress, but compared with the demand and the reality, there are still Therefore, it is of certain theoretical and practical significance to discuss the system of government information disclosure in our country.
Based on the comparative study and practice of China's open government information analysis in the information disclosure legal system of the major countries in the world today on the disclosure of government information from the concept, idea, system are analyzed. The thesis consists of three chapters: first, the basic theory of government information disclosure system. The analysis of the concept of open government information, discusses the theory of government information disclosure, summed up the government information public system. Two, by contrast, the research on public information legislation of foreign countries and China's current situation of government information publicity for reference. In three, the information disclosure regulations of China's new government "the implementation of the" as the starting point, discusses how to further improve the legal system of disclosure of government information in China.
