【摘要】:行政指導(dǎo)行為是我國行政民主化進(jìn)程中在行政管理領(lǐng)域被不斷提及的一種現(xiàn)代政府管理方式,也是非強(qiáng)制行政行為中最為重要的一個(gè)概念。近些年來,隨著我國政府由管理型向服務(wù)型的轉(zhuǎn)變,服務(wù)型政府的相關(guān)概念也得到越來越多的關(guān)注,但從現(xiàn)今的實(shí)際情況看來,行政指導(dǎo)行為恰恰就處在一個(gè)現(xiàn)實(shí)意義重大、理論基礎(chǔ)薄弱、實(shí)務(wù)問題甚多的一個(gè)較為尷尬的地位。因此,明確行政指導(dǎo)的正確定位及其可訴性,使得政府在行使相關(guān)服務(wù)職能、進(jìn)行相關(guān)行政指導(dǎo)的過程中有規(guī)則可用、有制度可遵;社會在接受政府行為、并對政府行為做出反饋的過程中有法可依、有律可循,并且在權(quán)益受到政府非強(qiáng)制性指導(dǎo)行為侵害時(shí)可以借助法律訴訟來維護(hù)自己的權(quán)益顯得勢在必行。 行政法領(lǐng)域的非強(qiáng)制性行政行為,尤其是行政指導(dǎo),是政府職能轉(zhuǎn)變中的首要問題,這是我國的法制化進(jìn)程不斷發(fā)展、法治水平不斷提高的必然趨勢。在我國民主法治潮流大勢的驅(qū)動(dòng)下,代表公權(quán)力的國家行政行為和以契約關(guān)系為紐帶的人與人關(guān)系總和的社會公共利益的協(xié)調(diào)問題是公法領(lǐng)域和私法領(lǐng)域都無法回避的一個(gè)重大問題,尤其是二者之間的關(guān)系問題,對占據(jù)優(yōu)勢地位的公權(quán)力對應(yīng)的公法領(lǐng)域的研究更是一種無法回避的義務(wù)。由此,作為能夠較好平衡公權(quán)力與私權(quán)利的行政指導(dǎo)行為的明確定位以及因受到與行政指導(dǎo)行為相關(guān)的影響而遭到的利益侵害情況下,能得到法律訴訟保護(hù)在行政領(lǐng)域中就凸顯出了重要性。 實(shí)踐中,我國行政指導(dǎo)定位的不清晰以及因行政指導(dǎo)行為而產(chǎn)生的利益遭受侵害的情況并未被納入到行政訴訟的可訴范圍,對我國的公權(quán)力限制以及對相對人的保護(hù)顯得缺失嚴(yán)重,,不利于我國行政領(lǐng)域的法制建設(shè),而對上述的問題研究就顯得尤為重要。 本文在較為細(xì)致的介紹國內(nèi)外行政指導(dǎo)行為相關(guān)理論及實(shí)務(wù)現(xiàn)狀的基礎(chǔ)上,通過文獻(xiàn)研究法,社會實(shí)證研究方法,比較分析的方法,得出行政指導(dǎo)行為作為典型的非強(qiáng)制性行為的權(quán)力屬性和事實(shí)行為到法律行為的階段延續(xù)性的性質(zhì)定位,以及行政指導(dǎo)行為可以納入行政訴訟范圍的必要性以及可行性。藉此,能夠使理論界對行政指導(dǎo)行為定位的統(tǒng)一和實(shí)務(wù)界對行政指導(dǎo)行為損害納入訴訟救濟(jì)的進(jìn)程能起到一定的總結(jié)和鋪墊作用。
[Abstract]:The administrative guidance behavior is a kind of modern government management mode which is constantly mentioned in the administrative field in the process of administrative democratization in our country. It is also the most important concept in the non-compulsory administrative behavior. In recent years. With the change of our government from management to service, more and more attention has been paid to the concept of service-oriented government. The behavior of administrative guidance is in an awkward position with great practical significance, weak theoretical foundation and many practical problems. Therefore, it is clear that the correct orientation of administrative guidance and its actionable nature. Make the government in the exercise of relevant service functions, the process of relevant administrative guidance has rules available, there are systems to comply with; The society has laws to follow and rules to follow in the process of accepting government behavior and making feedback to government behavior. Moreover, it is imperative to protect their rights and interests through legal proceedings when the rights and interests are infringed by the government. Non-compulsory administrative behavior in the field of administrative law, especially administrative guidance, is the primary issue in the transformation of government functions, which is the continuous development of the process of legalization in our country. The inevitable trend of improving the level of rule of law is driven by the trend of democracy and rule of law in our country. The coordination of the public interests between the state administrative acts representing the public power and the relationship between the people and the people is an unavoidable problem in the field of public law and private law. In particular, the relationship between the two issues, the dominant position of the public power corresponding to the field of public law research is an unavoidable obligation. As a better balance between public power and private rights of the administrative guidance of the clear positioning of the behavior and because of the impact of administrative guidance behavior suffered by the interests of the situation. It is very important to be protected by legal proceedings in the field of administration. In practice, the unclear orientation of our administrative guidance and the infringement of the interests arising from the administrative guidance actions have not been included in the scope of administrative litigation. The limitation of the public power and the protection of the relative person are seriously lacking, which is not conducive to the construction of the legal system in the administrative field of our country, and the study of the above problems is particularly important. On the basis of the detailed introduction of the theory and practice of administrative guidance behavior at home and abroad, this paper makes a comparative analysis through the methods of literature research, social empirical research and comparative analysis. The author draws the conclusion that the administrative guidance act is the power attribute of the typical non-compulsory act and the nature of the continuity from the factual act to the legal act. And the necessity and feasibility of administrative guidance behavior can be brought into the scope of administrative litigation. It can make the theory circle unify the orientation of the administrative guidance act and the practice circle can sum up and pave the way for the harm of the administrative guidance act to be brought into the process of litigation relief.
