社會(huì)主義憲政和黨內(nèi)民主建設(shè)不足是近年來學(xué)術(shù)界關(guān)注的熱點(diǎn)不足。本文把社會(huì)主義憲政與黨內(nèi)民主結(jié)合起來,力圖通過研究黨內(nèi)民主的制度化來架起通往社會(huì)主義憲政的橋梁。論文由三部分組成:第一部分,主要對(duì)憲政及社會(huì)主義憲政的概念進(jìn)行淺析淺析,在此基礎(chǔ)上總結(jié)出社會(huì)主義憲政的基本特點(diǎn)以及與資本主義憲政的本質(zhì)區(qū)別,并對(duì)一些相關(guān)的爭(zhēng)議不足給予了回應(yīng),成為本文的立論基礎(chǔ)。第二部分,從黨內(nèi)民主建設(shè)與執(zhí)政合法性、黨內(nèi)民主與人民民主和黨內(nèi)民主與法治建設(shè)三個(gè)方面淺析淺析了黨內(nèi)民主建設(shè)在社會(huì)主義憲政中的地位和作用,即黨內(nèi)民主的憲政價(jià)值,這是本文的重點(diǎn)。第三部分,提出了黨內(nèi)民主建設(shè)法治化的主要途徑,即開展全黨的民主法治觀念教育、黨要在憲法和法律范圍內(nèi)活動(dòng)以及建立健全黨內(nèi)法規(guī)體系。
【Abstract】 Recent years, the socialist constitutionalism and inner-party democracy building are very popular in academic areas. The article combines with these two points together, in order to build a bridge which going to the socialist constitutionalism through studying the institutionalization of inner-party democracy. This paper consists of three parts, in the first part, I mainly analyzing the concept of constitutionalism and socialist constitutionalism. And then I summarize basic characteristics of the socialist constitutionalism and essential differences between the socialist constitutionalism and capitalist constitutionalism. And I respond some relevant problems that are controversial. All of these are the foundations of this article. In the second part, I analyze the status and function of inner-party democracy building in the socialist constitutionalism from three parts which are inner-party democracy building and ruling legitimacy、inner-party democracy and people ’ s democracy、inner-party democracy and legal construction, that is constitutional value of inner-party democracy. This is the most important point in this paper. In the third part, I put forward main approaches to legal of inner-party democracy building including we should educate the idea of democratic legal system in the whole party and the CPC should be activity in the scope of the constitution and the law and we should establish the system of the inner-party laws and regulations and then make them more perfect.
