越南省級(jí)政府行政審批制度改革研究

【摘要】:實(shí)現(xiàn)越南省級(jí)政府行政審批制度改革是當(dāng)前緊迫的任務(wù)與要求。自1986年國(guó)家全面實(shí)行革新社會(huì)與經(jīng)濟(jì)至今,越南共產(chǎn)黨和越南中央政府已經(jīng)把推進(jìn)整個(gè)公共行政改革和行政審批制度改革當(dāng)成當(dāng)前重要的任務(wù)。在越南,“公共行政”作為一個(gè)新的概念,它真正出現(xiàn)是在計(jì)劃經(jīng)濟(jì)與集中官僚制向市場(chǎng)經(jīng)濟(jì)為導(dǎo)向的社會(huì)主義制國(guó)家轉(zhuǎn)型之后。由于國(guó)家尚無(wú)實(shí)施行政審批制度改革的經(jīng)驗(yàn),因此越南在行政審批制度改革與公共行政改革一樣,采取的也是邊實(shí)施邊探索邊學(xué)習(xí)和吸取經(jīng)驗(yàn)的過(guò)程。盡管越南的公共行政和行政審批制度有過(guò)二十多年的改革與完善,但是公共行政改革的結(jié)果還遠(yuǎn)遠(yuǎn)難以滿(mǎn)足社會(huì)與經(jīng)濟(jì)發(fā)展中的要求。為此,越南的公共行政還需要不斷的改革與完善,保證公共行政的通暢性,營(yíng)造良好的投資環(huán)境,不斷滿(mǎn)足公民和企業(yè)的日益增長(zhǎng)的需求,促進(jìn)國(guó)家社會(huì)與經(jīng)濟(jì)的良性發(fā)展。筆者把研究越南省級(jí)政府行政審批制度改革的問(wèn)題作為本人的博士論文。這篇論文除了導(dǎo)論和結(jié)語(yǔ)兩個(gè)部分,還構(gòu)建成五章。主要的內(nèi)容如下:導(dǎo)論部分要內(nèi)容是明確研究背景、研究意義與價(jià)值、與行政審批制度的有關(guān)理論和研究的理論根據(jù)、研究?jī)?nèi)容、研究方法和研究框架。第一章說(shuō)明越南共產(chǎn)黨對(duì)國(guó)家公共行政改革的總體來(lái)說(shuō)和行政審批制度改革的具體來(lái)說(shuō)的觀點(diǎn)、主張與途徑。這些系統(tǒng)化的行政審批制度改革主張與觀點(diǎn)在共產(chǎn)黨全國(guó)代表大會(huì)的文件中和其他有關(guān)的文件提到。同時(shí),本章也提及越南中央政府行政審批制度改革的舉措,并提出了實(shí)現(xiàn)黨指導(dǎo)下的行政審批制度改革的實(shí)施。另一方面,這章也說(shuō)明越南省級(jí)行政審批制度改革的內(nèi)容。依據(jù)越南其國(guó)情,越南的行政審批制度改革必須同時(shí)實(shí)施所有的內(nèi)容,不能實(shí)施單獨(dú)一個(gè)內(nèi)容。第二章的主要內(nèi)容是關(guān)于越南省級(jí)政府行政審批制度改革的成功與不足。第三章,筆者列舉出了越南省級(jí)行政審批制度改革的存在問(wèn)題,同時(shí)對(duì)存在問(wèn)題的原因進(jìn)行分析。在此章,通過(guò)在越南太原省進(jìn)行調(diào)研,明確公民和企業(yè)者對(duì)越南省級(jí)政府行政審批制度改革的評(píng)估的作用。 第四章是從國(guó)外行政聲批制度改革的寶貴經(jīng)驗(yàn)和其對(duì)越南省級(jí)政府行政審批制度改革的啟示。在本章,筆者主要研究美國(guó)和中國(guó)的經(jīng)驗(yàn)。盡管這兩個(gè)國(guó)家有不同的政治體制,但是都取得了許多成功的行政審批制度改革,同時(shí)這兩個(gè)國(guó)家也是世界上第一與第二經(jīng)濟(jì)發(fā)達(dá)的國(guó)家。這兩個(gè)國(guó)家發(fā)展都深受行政審批制度改革成功的影響。因此,越南可以從中夠取得許多寶貴的經(jīng)驗(yàn)作為越省級(jí)政府行政審批制度改革的啟示。 第五章,通過(guò)研究越南省級(jí)政府行政審批制度改革的內(nèi)容、成果與不足,和世界上各國(guó)的經(jīng)驗(yàn),筆者提出越南省級(jí)政府行政審批制度改革的思考與對(duì)策。本章的主要內(nèi)容是:一是,越南行政審批制度改革的考慮;二是,越南行政審批制度改革的選擇方法。在總結(jié)研究結(jié)果的基礎(chǔ)上,筆者已經(jīng)提出了為更好的實(shí)現(xiàn)越南省級(jí)政府行政審批制度改革的基本對(duì)策。 結(jié)語(yǔ)部分,這部分的主要內(nèi)容是從研究過(guò)程的結(jié)果,筆者總結(jié)來(lái)幾個(gè)結(jié)論,結(jié)論的內(nèi)容包括:越南省級(jí)政府行政審批制度改革的緊迫性,越南省級(jí)政府行政審批制度改革的實(shí)施過(guò)程,越南省級(jí)政府行政審批制度改革的內(nèi)容,越南省級(jí)政府行政審批制度改革的成果,越南省級(jí)政府行政審批制度改革的不足,越南省級(jí)政府行政審批制度改革不足的原因。
[Abstract]:It is an urgent task and requirement to reform the administrative examination and approval system of the provincial governments in Vietnam. Since the state fully implemented the reform of society and economy in 1986, the Communist Party of Vietnam and the central government of Vietnam have made it an important task to promote the reform of the whole public administration and the administrative examination and approval system. As a new concept, it really appeared after the transformation of planned economy and centralized bureaucracy into a socialist country oriented by market economy. As the country has no experience in implementing the reform of the administrative examination and approval system, Vietnam, like the reform of public administration, has adopted the method of exploring and learning while implementing the reform of the administrative examination and approval system. Although Vietnam's public administration and administrative examination and approval system has been reformed and perfected for more than 20 years, the results of public administration reform are far from meeting the requirements of social and economic development. To create a good investment environment to meet the growing needs of citizens and enterprises and to promote the healthy development of the country's society and economy, the author takes the research on the reform of the administrative examination and approval system of Vietnam's provincial government as my doctoral dissertation. The following: The main content of the introduction is to clarify the research background, research significance and value, the theoretical basis, research content, research methods and research framework of the administrative examination and approval system. These ideas and viewpoints are mentioned in the documents of the National Congress of the Communist Party and other relevant documents. At the same time, this chapter also refers to the measures taken by the Central Government of Vietnam to reform the administrative examination and approval system, and puts forward the implementation of the reform of the administrative examination and approval system under the guidance of the Party. According to Vietnam's national conditions, the reform of the administrative examination and approval system in Vietnam must implement all the contents at the same time, and can not implement a single content. The main content of the second chapter is about the success and shortcomings of the reform of the administrative examination and approval system in Vietnam's provincial government. In this chapter, through the investigation in Taiyuan Province of Vietnam, the role of citizens and entrepreneurs in assessing the reform of the provincial government administrative examination and approval system in Vietnam is clarified.
The fourth chapter is the valuable experience of the reform of the administrative approval system abroad and Its Enlightenment to the reform of the administrative approval system of the provincial governments in Vietnam. The development of these two countries is deeply influenced by the success of the reform of the administrative examination and approval system. Therefore, Vietnam can gain a lot of valuable experience as a revelation for the reform of the administrative examination and approval system of the provincial governments.
Chapter five, through studying the contents, achievements and shortcomings of the reform of the administrative examination and approval system of Vietnam's provincial governments, and the experiences of other countries in the world, the author puts forward the thinking and Countermeasures of the reform of the administrative examination and approval system of Vietnam's provincial governments. On the basis of summarizing the research results, the author has put forward the basic countermeasures for better realizing the reform of administrative examination and approval system of Vietnam provincial government.
In conclusion, the main content of this part is the result of the research process. The author summarizes several conclusions, including: the urgency of the reform of the administrative examination and approval system of the provincial government of Vietnam, the implementation process of the reform of the administrative examination and approval system of the provincial government of Vietnam, the content of the reform of the administrative examination and approval system of the provincial government of Vietnam, and the provincial government of Vietna The achievements of the reform of the government administrative examination and approval system, the insufficiency of the reform of the provincial government administrative examination and approval system in Vietnam, and the reasons for the insufficiency of the reform of the provincial government administrative examination and approval system in Vietnam.
