【摘要】：流行于中世紀(jì)英格蘭的限嗣繼承是一種特殊形式的家庭內(nèi)部分封,它源于地產(chǎn)主家長(zhǎng)為女兒提供嫁資的習(xí)俗。后來,被廣泛用于為家庭中的余子提供資助,從而成為地產(chǎn)主規(guī)避以長(zhǎng)子繼承制為主要特征的普通法繼承規(guī)則的常用手段。14世紀(jì),限嗣繼承演變成限男嗣繼承,這種新型的限嗣繼承背離了地產(chǎn)主設(shè)計(jì)限嗣繼承的初衷,又重新開始強(qiáng)調(diào)長(zhǎng)子繼承權(quán)益,以確保家系流傳。盡管如此,限男嗣繼承與之前的限嗣繼承一樣,同是適應(yīng)時(shí)代需求而生的產(chǎn)物。
[Abstract]:In medieval England, limited inheritance is a special form of family seal, which originates from the custom of property owners to provide their daughters with money. Later, it was widely used to finance the remaining children in the family, thus becoming a common means for property owners to circumvent the common law inheritance rules characterized mainly by the eldest son succession. This new type of limited inheritance deviates from the original intention of the real estate owners to restrict the inheritance, and reemphasizes the rights and interests of the eldest son in order to ensure the spread of the family. In spite of this, the inheritance of a male is a product of the times, just like the previous inheritance.
