【摘要】：美國在南極的考察歷史最久、活動(dòng)范圍最廣,主導(dǎo)了1959年《南極條約》的締結(jié)并引領(lǐng)了南極條約體系的走向。美國的南極政策目標(biāo)是確保"積極而有影響的存在"。為此,美國建立了主管南極事務(wù)的部門框架及政策協(xié)調(diào)機(jī)制,出臺了南極立法,采取了有效的執(zhí)行措施。中國是南極事務(wù)的"后來者"和"非主權(quán)要求國",在南極事務(wù)上與美國有共同的利益和關(guān)切,但在參與南極事務(wù)的能力、南極政策的目標(biāo)定位以及南極政策法律的制定與實(shí)施等諸多方面與美國存在較大差距。美國的南極政策與法律對我國有重要的啟示。
[Abstract]:The United States has the longest history and the widest range of activities in Antarctica, which led to the conclusion of the Antarctic Treaty in 1959 and the trend of Antarctic Treaty system. America's Antarctic policy goal is to ensure a positive and influential presence. For this reason, the United States has established the department framework and policy coordination mechanism in charge of Antarctic affairs, enacted Antarctic legislation and taken effective enforcement measures. As a "latecomer" and "non-sovereign claimant" in Antarctic affairs, China shares common interests and concerns with the United States in Antarctic affairs, but has the ability to participate in Antarctic affairs. The target orientation of Antarctic policy and the formulation and implementation of Antarctic policy and law are quite different from those of the United States. American Antarctic policy and law have important enlightenment to our country.
