【摘要】：明治維新后,日本在近代國家建設(shè)上全面學(xué)習(xí)西方,為此而聘請了許多外國顧問,德國學(xué)者莫塞便是其中最重要的人物之一。莫塞繼承了其師德國著名憲法和行政法學(xué)者格奈斯特的衣缽,作為日本內(nèi)閣及內(nèi)務(wù)省的法律顧問,莫塞堅(jiān)決主張日本在發(fā)布憲法、開設(shè)國會(huì)前實(shí)行地方自治制度,并極力將地方名望家族統(tǒng)治理念引入日本,由此在推動(dòng)日本實(shí)現(xiàn)了地方制度近代化的同時(shí),也留下了西方近代法制與日本現(xiàn)實(shí)融合的課題。
[Abstract]:After the Meiji Restoration, Japan learned from the West comprehensively in the construction of modern countries. For this reason, many foreign consultants were hired, and the German scholar Mercer was one of the most important figures.As a legal adviser to the Japanese Cabinet and the Ministry of the Interior, Morse insisted that Japan adopt a system of local autonomy before issuing a constitution and opening a parliament.The idea of local famous family rule was introduced into Japan, which not only promoted the modernization of local system in Japan, but also left the subject of the fusion of western modern legal system and Japanese reality.
