【摘要】：日本明治時(shí)期,由于曾高舉"天賦人權(quán)"理論大旗的著名啟蒙思想家加藤弘之在政治思想上的轉(zhuǎn)向,圍繞天賦人權(quán)問題,社會(huì)輿論界展開了一場著名的思想交鋒。交鋒主要集中于人類權(quán)利是否為天賦、人類要獲得權(quán)利是否只能通過優(yōu)勝劣汰的競爭手段、人類與動(dòng)植物的生存競爭和自然淘汰有無區(qū)別、人權(quán)與法權(quán)有無區(qū)別等焦點(diǎn)問題激烈展開。日本社會(huì)輿論大多數(shù)對加藤否定天賦人權(quán)的學(xué)說進(jìn)行了批判,澄清了一些政治學(xué)說中的模糊概念,為即將出現(xiàn)的新憲法的人權(quán)保障內(nèi)容提供了思想依據(jù)。
[Abstract]:During the Meiji period of Japan, the famous enlightenment thinker, Hiroshi Kato, who held high the banner of the theory of "natural human rights", turned around the issue of human rights in nature. There is a famous ideological confrontation in the field of social public opinion. The confrontation mainly focuses on whether human rights are natural or not, and whether human beings can only obtain rights through the competitive means of survival of the fittest. Whether there is any difference between survival competition and natural elimination between human beings and animals and plants, and whether human rights and legal rights are different or not, and so on, the focus of which is the fierce development. Most Japanese public opinion criticizes Kato's theory of negating the natural right to human rights. It clarifies some vague concepts in political theory and provides the ideological basis for the human rights guarantee content of the forthcoming new constitution.
