【摘要】： 當(dāng)代印度的政治制度與西方國(guó)家基本一致,就是以議會(huì)民主制為核心,包括行政制度、司法制度和政黨制度在內(nèi)的一整套完整體系。印度的政治制度植根于印度的土壤之中,有它的歷史淵源。近代印度是在英國(guó)殖民統(tǒng)治下成為一個(gè)統(tǒng)一的英印帝國(guó)。英國(guó)殖民者將他們的政治制度移植到印度,形成近代的印度政治制度。獨(dú)立后印度的政治制度是以英國(guó)的政治制度為模式,但又是從印度的國(guó)情出發(fā),在印度社會(huì)這一特定環(huán)境下確立并運(yùn)行的,從而帶有印度的特色。前言主要闡述了國(guó)內(nèi)外關(guān)于印度政治制度的研究現(xiàn)狀、本課題的研究意義及其基本思路與方法,同時(shí)對(duì)相關(guān)概念進(jìn)行了界定。 全文共分四個(gè)部分: 第一部分闡述印度政治制度的確立。近代印度作為英國(guó)的一個(gè)殖民地,其政治制度是由英國(guó)殖民者移植過來的。這個(gè)移植過程是緩慢而漸進(jìn)的。由于殖民統(tǒng)治的需要和印度的現(xiàn)實(shí)環(huán)境,這個(gè)移植過來的政治制度實(shí)際上是英國(guó)議會(huì)民主制的異化,它深深地影響了獨(dú)立后的印度政治體制。獨(dú)立后,印度的國(guó)家精英開始了對(duì)本國(guó)政治制度的設(shè)計(jì)與制定。隨后,印度成立制憲會(huì)議,確立了選舉制、內(nèi)閣制、中央機(jī)關(guān)系統(tǒng)、聯(lián)邦和邦的職權(quán)關(guān)系、邦機(jī)構(gòu)設(shè)置及土邦等眾多制度內(nèi)容。這些問題的順利完成,為印度政治制度的最終確立及今后體制的正常運(yùn)轉(zhuǎn)奠定了基礎(chǔ)。 第二部分論證印度政治制度的主要內(nèi)容和特點(diǎn)。印度是議會(huì)民主制,名義上議會(huì)是國(guó)家的最高權(quán)力機(jī)構(gòu),行政機(jī)關(guān)由議會(huì)選舉產(chǎn)生,必須對(duì)議會(huì)負(fù)責(zé)、報(bào)告工作并接受其監(jiān)督。但事實(shí)上,印度的立法機(jī)關(guān)實(shí)際權(quán)力弱小。在制定法律、外交事務(wù)和財(cái)政監(jiān)督等重要職權(quán)上處處受制于行政機(jī)關(guān)。與此相對(duì)應(yīng),行政機(jī)關(guān)權(quán)力逐漸膨脹,掌握了國(guó)家的政治、經(jīng)濟(jì)、軍事命脈,在國(guó)家權(quán)力結(jié)構(gòu)中處于實(shí)際上的核心地位。印度司法系統(tǒng)的獨(dú)立性和公正性還相當(dāng)脆弱,尤其是政治干預(yù)司法的現(xiàn)象始終存在。解決司法制度獨(dú)立性和公正性較差的問題,完善和健全司法體系仍然任重道遠(yuǎn)。政黨制度是政治制度的重要組成部分。印度的政黨數(shù)目繁多且構(gòu)成混亂動(dòng)蕩。 第三部分論述印度政治制度的運(yùn)作及功能。議會(huì)選舉是印度政治制度順利運(yùn)轉(zhuǎn)的基礎(chǔ)。通過多年的現(xiàn)實(shí)操作和經(jīng)驗(yàn)積累,印度的選舉制度逐步鞏固和完善,選民參與選舉的水平和程度不斷提高,不少問題在實(shí)踐中逐漸被克服。各國(guó)家機(jī)關(guān)組成后,其正常運(yùn)轉(zhuǎn)和權(quán)力交替的制度化是保障國(guó)家機(jī)構(gòu)穩(wěn)定與持續(xù)的關(guān)鍵。與此同時(shí),議會(huì)民主制下反對(duì)黨和壓力集團(tuán)通過議會(huì)內(nèi)外的活動(dòng)影響國(guó)家法律、政策的制定形成是不可避免的,印度同樣如此。在印度,根據(jù)制憲會(huì)議的設(shè)計(jì),司法系統(tǒng)對(duì)議會(huì)和行政建立了相互制衡的關(guān)系。司法對(duì)行政具有一定獨(dú)立性但又受行政影響,司法和議會(huì)也相互制衡。但是,司法和議會(huì)、行政的相互制約是不平衡的,在議會(huì)和行政強(qiáng)有力的情況下,司法的制約較為軟弱。印度作為一個(gè)種姓、民族、宗教都十分復(fù)雜,矛盾非常尖銳的國(guó)家,沒有發(fā)生像不少發(fā)展中國(guó)家的軍事政變和軍事獨(dú)裁政權(quán)的現(xiàn)象,其現(xiàn)代政治制度發(fā)揮的穩(wěn)定功能以及形成和維護(hù)公共權(quán)力的功能無疑起了中流砥柱的作用。 第四部分是對(duì)印度政治制度的評(píng)價(jià)。主要論述了印度政治制度的歷史地位,肯定了印度的民主政治制度是印度資產(chǎn)階級(jí)爭(zhēng)取民族獨(dú)立斗爭(zhēng)和維護(hù)民族獨(dú)立成果在政治上的體現(xiàn),這種制度的確立使印度在政治民主化方面向前大大地邁出了一步。當(dāng)然,印度政治制度還有諸多缺陷,面臨著不少挑戰(zhàn),如不能妥善處理這些問題和漏洞,印度政治制度的運(yùn)轉(zhuǎn)和政治現(xiàn)代化的進(jìn)程必將受到嚴(yán)重干擾。 總之,以議會(huì)民主制為基礎(chǔ)的政治制度的建立與實(shí)施是印度獨(dú)立后國(guó)力穩(wěn)定發(fā)展的根本保障。其實(shí)踐半個(gè)世紀(jì)以來的經(jīng)驗(yàn)與教訓(xùn)值得廣大發(fā)展中國(guó)家參考、借鑒。
[Abstract]:The political system of India is basically the same as that of western countries . It is the core of parliamentary democracy , including the administrative system , the judicial system and the political party system . The full text is divided into four parts : The first part illustrates the establishment of the Indian political system . Modern India is a colony in the United Kingdom . Its political system is transplanted by British colonizers . The transplant process is slow and gradual . As a result of the needs of colonial rule and the reality environment of India , the transplanted political system has influenced the design and development of the country ' s political system . The second part demonstrates the main content and characteristics of India ' s political system . India is a parliamentary democracy , nominally parliament is the supreme authority of the country , the executive organ is elected by the parliamentary elections , it must be responsible for the parliament , report the work and accept its supervision . But in fact , the independence and impartiality of the judicial system of India are still very fragile . The system of political party is an important part of the political system . The number of political parties in India is numerous and constitutes chaos and unrest . The third part discusses the operation and function of the political system in India . The parliamentary election is the foundation of the smooth operation of the political system in India . After many years of practical operation and experience accumulation , the electoral system of India has been gradually consolidated and perfected , and many problems have been gradually overcome in practice . The fourth part is the evaluation of India ' s political system . The history status of India ' s political system is discussed . It is affirmed that the democratic political system of India is the political representation of the struggle for national independence and the maintenance of national independence . The establishment of this system has made India a significant step forward in political democratization . Of course , there are many flaws in India ' s political system , such as the failure to properly handle these problems and vulnerabilities , and the running of the political system of India and the process of political modernization will be severely disrupted . In short , the establishment and implementation of the political system based on the parliamentary democracy is the fundamental guarantee of the stable development of the state power after independence of India . The experience and lessons of its practice in half a century deserve the reference from the developing countries .
