【摘要】：2001年底,廣西北海市中級人民法院一審認(rèn)定北海“西頭幫”犯罪團(tuán)伙不屬于“具有黑社會性質(zhì)的犯罪組織”。公訴機(jī)關(guān)為此提出抗訴。這不但在廣西引起強(qiáng)烈反響,還引發(fā)了一場在司法實(shí)踐中如何認(rèn)定“黑社會性質(zhì)犯罪組織”的爭議。而一審宣判后司法機(jī)關(guān)及相關(guān)執(zhí)法部門相繼挖出的“保護(hù)傘”,使得這一案件變得更加復(fù)雜。
[Abstract]:At the end of 2001, the Guangxi Beihai Intermediate people's Court found that the "Xitou gang" criminal gang in Beihai did not belong to the "criminal organization with the nature of triad society". The public prosecution organ filed a protest against this. This not only causes strong reactions in Guangxi, but also causes a dispute over how to identify "underworld criminal organizations" in judicial practice. The case became more complicated by the "umbrella" dug up by the judiciary and relevant law enforcement departments one after another after the judgment of the first instance.
