【摘要】：近代中國半封建半殖民地性質(zhì)的社會制度下的社會動蕩不安,主權(quán)的非獨立性,社會內(nèi)部各種力量的劇烈沖突,決定了近代中國偵查的半封建半殖民地性質(zhì)。近代偵查的軍事色彩依然濃厚,外國列強在中國領(lǐng)土上行使偵查審判權(quán),國家司法獨立喪失,偵查制度出現(xiàn)了獨立化的萌芽,并朝著近代化緩慢發(fā)展。中國古代偵查蓬勃發(fā)展的勢頭到近代日趨減弱,偵查技術(shù)停滯不前,偵查理論和方法的研究幾乎處于空白狀態(tài)。中國偵查逐漸處于落后地位,現(xiàn)代偵查科學(xué)終究未能從偵查職能的發(fā)源地——華夏中國的土壤中滋生出來。
[Abstract]:Under the social system of semi-feudal and semi-colonial nature in modern China, the social unrest, the non-independence of sovereignty and the violent conflict of various forces within the society determined the semi-feudal and semi-colonial nature of modern Chinese investigation. The military color of modern investigation is still strong, foreign powers exercise the jurisdiction of investigation in Chinese territory, the national judicial independence is lost, the investigation system appears the germination of independence, and develops slowly towards modernization. The momentum of the vigorous development of investigation in ancient China is weakening day by day in modern times, the investigation technology is stagnant, and the research of investigation theory and method is almost blank. Chinese investigation is gradually in a backward position, and modern investigation science has failed to breed from the soil of China, the birthplace of investigation function.
