我國當代女性犯罪社會誘因淺析

【摘要】： 女性犯罪是當今社會不容忽視的一個重要問題,不但給眾多家庭造成了悲劇,而且對社會的危害程度日趨嚴重,已經(jīng)成為影響經(jīng)濟發(fā)展、社會穩(wěn)定的不可忽視的因素,應當引起高度重視。面對當前中國社會女性犯罪不斷上升和蔓延的態(tài)勢,關(guān)于女性犯罪的原因探討已成為一個受到廣泛關(guān)注的熱點。本文從社會性別視角出發(fā),在相關(guān)法學理論的指導下,通過文獻檢索和實地研究,運用問卷調(diào)查和個案訪談相結(jié)合的方法,對社會轉(zhuǎn)型期女性犯罪進行分析,探討女性犯罪的社會原因,力求突破一些傳統(tǒng)的看法,澄清一些認識上的誤區(qū),改變以往把女性自身素質(zhì)作為導致女性犯罪的根源的觀念。 本文分三個部分五個章節(jié)進行論述。 第一部分是前言部分。界定了女性犯罪的一般概念、當今女性違法犯罪現(xiàn)狀、以及國內(nèi)外犯罪學家和社會學家對女性這一特殊犯罪群體的犯罪原因的研究概況,指出女性犯罪原因與男性犯罪相比,有一定的特殊性,應引起特別的重視,并應當將其置于社會大背景中予以研究。 第二部分分四個章節(jié),從社會體制、社會角色、社會文化、婚姻家庭四個方面深入剖析導致女性犯罪的社會誘因,揭示女性犯罪問題背后的資源不平等及性別不平等問題,綜合地分析誘導女性犯罪的社會因素。 第一章“我國社會體制轉(zhuǎn)型對女性犯罪的誘因分析”。從社會體制角度分析論證了我國體制轉(zhuǎn)型對誘導女性犯罪產(chǎn)生的影響。社會大規(guī)模的流動減弱了職能部門對流動女性的控制力,流動女性又很難適應新的社會環(huán)境,迫于生計,流動女性犯罪現(xiàn)象便大量滋生。另外,市場經(jīng)濟大發(fā)展的同時,也帶來了一定的負面影響,如拜金主義盛行、女性就業(yè)難、經(jīng)濟地位低等問題都進一步誘發(fā)了女性心態(tài)的失衡,導致女性違法犯罪升級。 第二章“我國當代女性犯罪誘因的社會角色分析”。從新時期女性社會角色發(fā)生變遷這一角度入手,論證了社會轉(zhuǎn)型時期,隨著女性與社會接觸越來越頻繁、對社會角色的參與越來越多,女性產(chǎn)生了難以克服的角色失調(diào)現(xiàn)象,社會角色沖突、社會角色不清、社會角色中斷、社會角色失敗等問題使越來越多的女性產(chǎn)生困惑。在各種因素刺激下,自制力較差的女性便容易產(chǎn)生社會越軌行為的沖動性,誘發(fā)犯罪。 第三章“我國當代女性犯罪誘因的社會文化因素分析”。論證了社會文化因素對女性犯罪的重要影響。分三個層次進行分析:首先,隨著當今多元化的文化觀念不斷沖擊女性的思想領(lǐng)域,文化觀念沖突不斷加劇,女性的婚姻家庭觀念、性觀念無不受到強烈的震蕩,產(chǎn)生巨大變遷。其次,我國幾千年的封建家庭倫理觀念、具有性別歧視的社會文化傳統(tǒng)至今影響著女性在家庭和社會中的地位。再次,社會對女性同情憐憫的刻板心理無形間放縱了女性違法犯罪者。這些文化因素在不同條件的作用下,都在不同程度上成為誘導女性走上犯罪道路的催化劑。 第四章“女性犯罪誘因的婚姻家庭背景分析”。從婚姻家庭背景角度分析女性犯罪的誘因�；橐黾彝ヒ蛩厥钦T導女性犯罪的最重要因素。其中著重論證了家庭暴力對女性暴力犯罪的重大影響。筆者在此多著筆墨詳細分析了家庭暴力的社會現(xiàn)狀、引起的社會后果以及其背后隱藏的社會原因,力求透徹分析家庭暴力行為深刻的社會背景,從而找到受虐女性“以暴制暴”犯罪的根源。同時,婚姻和感情危機、狹隘的家庭親情也容易使女性喪失理智,最終導致其行為失范。 第五章“女性犯罪的法律控制與社會預防機制”。針對以上分析論證的誘導女性犯罪的社會原因,筆者提出了粗淺的建議。從加強對女性法律權(quán)益的保護、構(gòu)建反家庭暴力的法律環(huán)境、實現(xiàn)社會全方位的預防控制三方面入手,建議在加大立法、司法、執(zhí)法力度的同時,不斷健全調(diào)解組織、婦聯(lián)組織、社會治安綜合治理機構(gòu)等基層組織,以便形成強大的社會網(wǎng)絡,建立起科學的、切實可行的控制機制,力求將女性犯罪扼殺于萌芽之中。 第三部分是結(jié)語部分。簡要闡述了本文的研究目的,以及以犯罪學和社會學的一般理論與女性自身特點緊密結(jié)合的研究特色,并特別強調(diào)了在社會學視野下研究女性犯罪誘因的必要性。從而呼吁有關(guān)學者加強對女性犯罪這一邊緣學科的重視。
