【摘要】： 講求效益是一切活動的出發(fā)點和歸宿。在社會主義市場經(jīng)濟條件下,作為社會活動中的偵查活動這一特殊行業(yè)受到政府和社會各界越來越多的關(guān)注,偵查機關(guān)開展偵查活動的本質(zhì)同樣是效益問題,其中包括經(jīng)濟效益和社會效益。而機關(guān)內(nèi)部,偵查效益問題亦成為我國偵查機關(guān)各級領(lǐng)導(dǎo)者們的中心話題。在中國的刑事訴訟中,偵查是整個刑事訴訟程序的重心,是國家刑事訴訟成本投入最大的階段,偵查階段效益的高低決定了刑事訴訟整體效益的高低,因此,要提高刑事訴訟效益不在于簡化本已簡單的法庭審判程序,而在于提高偵查環(huán)節(jié)的效益。本文圍繞偵查效益所涉及的基本問題,從偵查效益概念、偵查效益內(nèi)涵、影響偵查效益的因素、偵查效益的基本原則、提高偵查效益的途徑等五個方面作以探討。 第一部分:圍繞偵查效益的概念涉及的相關(guān)理論問題作以分析研究。首先指出什么是效益及其效益的一般經(jīng)濟理論知識,在此基礎(chǔ)上闡述偵查效益的提起,并對學(xué)者對偵查效益概念的不同界定給與分析比較,然后分別對與偵查效益密切相關(guān)的效率、公正、效用、刑事訴訟效益等四個概念分析比較,闡明彼此間的關(guān)系。 第二部分:全面闡述了偵查效益的內(nèi)涵,偵查效益主要包括偵查經(jīng)濟效益和偵查社會效益兩個方面,并論述兩者之間的辯證關(guān)系。對偵查經(jīng)濟效益的分析,就是要運用經(jīng)濟學(xué)(主要是微觀經(jīng)濟學(xué))的概念、理論和方法來探討、研究偵查理論和實踐問題,以期盡可能在偵查收益與偵查成本之間達(dá)到效果最佳的組合,實現(xiàn)偵查效益最大化這個終極目標(biāo);偵查社會效益是指偵查機關(guān)在實施偵查活動的過程中,合理利用有限的偵查資源,公正、高效地打擊犯罪和犯罪嫌疑人,最大限度地提高社會公眾的安全系數(shù)以及社會對于偵查工作給與的肯定性評價。必須始終把實現(xiàn)社會效益最大化放在第一位,在此基礎(chǔ)上努力提高偵查經(jīng)濟效益,堅持社會效益優(yōu)先,兼顧經(jīng)濟效益的原則,從大處著眼,小處著手,適時調(diào)整和處理好二者的關(guān)系。 第三部分:講述的是影響偵查效益的因素。有兩大版塊構(gòu)成,分別從偵查效益的兩個構(gòu)成要件——偵查成本和偵查收益兩個方面來闡述。由于偵查活動面對的是復(fù)雜的犯罪客體,影響偵查工作開展的因素也是多方面的,注定影響偵查效益高低的因素也是多方面的,有偶然的因素,也有比然的因素;有客觀的因素,也有主觀的因素。本節(jié)從幾個主要方面加以論述。第一版塊是圍繞對偵查成本的分析,從偵查體制、偵查主體、犯罪、法治建設(shè)、輿論供給五個方面分別闡述了對偵查成本影響;第二版塊是圍繞對偵查收益的分析,從偵查體制、偵查主體、犯罪、偵查方法四個方面分別闡述了對偵查收益的影響。 第四部分:主要闡述了提高偵查效益的三大基本原則。首先是迅速及時原則,偵查工作的開展是一項時機性很強的活動,這就要求偵查人員一定要抓緊時間,抓住戰(zhàn)機。機不可失,時不再來,戰(zhàn)機問題是偵查工作能否取得成功的重要因素,抓住了戰(zhàn)機,偵查工作就取得了主動性,偵查工作整體效益的提高也就有了前提,有了條件;失去了戰(zhàn)機,偵查工作必定要投入更大的偵查資源,在很大程度上就決定了偵查效益的低下。其次是偵查資源合理配置原則,首先從經(jīng)濟學(xué)的角度闡述了資源配置的基本理論問題,在此基礎(chǔ)上指明了傳統(tǒng)的偵查資源配置方式,并指出不合理的偵查資源配置對偵查效益提高的制約作用,以強調(diào)偵查資源合理配置的重要性,只有通過資源的計劃和市場兩種配置方式,最大可能地將有限的偵查資源給與合理的運用,以期達(dá)到理想的偵查收益效果。最后是論述了偵查活動兼顧公正和效率的原則。 第五部分:闡述的是提高偵查效益的基本途徑問題。分別從完善偵查體制改革,加強偵查法治化建設(shè)、轉(zhuǎn)變觀念,向科技要效益、以人為本,專群結(jié)合,全面提升偵查隊伍戰(zhàn)斗力、加強偵查隊伍建設(shè),提高偵查人員的整體素質(zhì)、擺正對犯罪的偵、控、防關(guān)系,建立變被動偵查為主動防控的長效機制、統(tǒng)籌個案業(yè)績與可持續(xù)發(fā)展等六個方面著重論述,旨在為當(dāng)前低下的偵查效益尋求可行的提高途徑。
