上海市青少年暴力犯罪的演變及其對(duì)策思考

【摘要】： 自十一屆三中全會(huì)以來(lái),隨著改革開放和社會(huì)主義市場(chǎng)經(jīng)濟(jì)體制的確定,中國(guó)社會(huì)進(jìn)入全面轉(zhuǎn)型期,伴隨著經(jīng)濟(jì)高速發(fā)展的同時(shí),各種社會(huì)問題也紛紛浮出水面。青少年違法犯罪就是其中一大頑疾。近年來(lái),我國(guó)的青少年犯罪現(xiàn)象愈來(lái)愈嚴(yán)重,已成為社會(huì)各界關(guān)注的一個(gè)焦點(diǎn)。從犯罪性質(zhì)來(lái)看,現(xiàn)在的青少年犯罪比過(guò)去嚴(yán)重很多,這不在于犯罪的數(shù)量、比重的增加,而在于犯罪的嚴(yán)重性、危害性的增加。青少年暴力犯罪的比重和程度都增加了很多,如殺人、搶劫、強(qiáng)奸、惡性傷害案件占的比重越來(lái)越大。青少年是祖國(guó)的未來(lái),民族的希望,是社會(huì)主義事業(yè)的建設(shè)者和接班人,重視和加強(qiáng)對(duì)青少年的培養(yǎng)教育,預(yù)防青少年違法犯罪是關(guān)系到社會(huì)主義現(xiàn)代化建設(shè)的大事。 上海作為我國(guó)改革開放和經(jīng)濟(jì)發(fā)展前沿的特大城市,其社會(huì)環(huán)境與內(nèi)地許多地方有較大的差異,上海的青少年暴力犯罪也較多的帶有大城市的特點(diǎn)。本文本著理論研究服務(wù)于社會(huì)實(shí)踐的基本宗旨,認(rèn)真回顧上海市青少年暴力犯罪的演變及防治歷程,探討引起上海市青少年暴力犯罪演變的原因和條件,分析各種因素之間的相互關(guān)系,然后有針對(duì)性地提出相應(yīng)措施消除這些消極現(xiàn)象,借以鏟除形成青少年暴力犯罪的土壤。 本文共分三個(gè)部分,共三萬(wàn)一千余字。 第一部分,上海市青少年暴力犯罪的演變及發(fā)展趨勢(shì)。文章按照時(shí)間的順序回顧了上海市青少年暴力犯罪類型的轉(zhuǎn)變、犯罪數(shù)量的增加、犯罪性質(zhì)的變化,完整地對(duì)上海市青少年暴力犯罪演變進(jìn)行闡述。并從犯罪數(shù)量、犯罪類型、犯罪主體、犯罪組織形式、犯罪手段、犯罪發(fā)生地、以及案發(fā)的起因等多種角度對(duì)上海市青少年暴力犯罪的發(fā)展趨勢(shì)進(jìn)行了分析。 第二部分,上海市青少年暴力犯罪演變的原因分析。文章針對(duì)上海市青少年暴力犯罪主體的特定型、行為方式的特殊性和上海大都市等特點(diǎn),在分析青少年自身因素時(shí),著重分析青少年自身的人格方面缺陷以及世界觀和人生觀方面存在的不足;在分析社會(huì)因素時(shí),除了政治背景、經(jīng)濟(jì)發(fā)展、家庭、學(xué)校、社區(qū)等因素外,著重分析上海在都市化進(jìn)程中帶來(lái)的影響。 第三部分,上海市青少年暴力犯罪的防治對(duì)策思考。文章首先回顧了上海市通過(guò)立法、司法以及綜合治理等多種手段對(duì)青少年暴力犯罪的防治歷程。然后有針對(duì)性地從社會(huì)、家庭、學(xué)校中容易造成青少年暴力犯罪傾向的社會(huì)因素方面提出對(duì)策,通過(guò)加強(qiáng)家庭教育、抓好學(xué)校教育、凈化大眾傳媒、消除丑惡現(xiàn)象、加強(qiáng)對(duì)流動(dòng)人口管理,特別是要牢固樹立和實(shí)踐社會(huì)主義榮辱觀,來(lái)創(chuàng)造一個(gè)適合青少年發(fā)展的良好氛圍,我們才可以盡可能減少和消除青少年暴力犯罪,把青少年暴力犯罪控制在一定的范圍內(nèi),切實(shí)維護(hù)穩(wěn)定的社會(huì)局面。
[Abstract]:Since the third Plenary session of the 11th CPC Central Committee, with the reform and opening up and the determination of the socialist market economic system, Chinese society has entered a comprehensive transition period. With the rapid economic development, various social problems have also surfaced. Juvenile delinquency is one of the major diseases. In recent years, the phenomenon of juvenile delinquency in China is becoming more and more serious, which has become a focus of attention from all walks of life. From the point of view of the nature of crime, juvenile delinquency is much more serious than in the past, which lies not in the number and proportion of crimes, but in the seriousness and harmfulness of crimes. The proportion and degree of juvenile violent crime have increased a lot, such as murder, robbery, rape and malignant injury. Young people are the future of the motherland and the hope of the nation, and they are the constructors and successors of the socialist cause. Paying attention to and strengthening the training and education of young people and preventing juvenile delinquency are related to the socialist modernization drive. As a mega-city in the forefront of reform, opening up and economic development in China, the social environment of Shanghai is quite different from that of many places in the mainland, and the violent crimes committed by teenagers in Shanghai are also characterized by large cities. Based on the basic purpose of theoretical research serving social practice, this paper seriously reviews the evolution and prevention of juvenile violent crimes in Shanghai, and probes into the causes and conditions of the evolution of juvenile violent crimes in Shanghai. This paper analyzes the relationship between various factors, and then puts forward corresponding measures to eliminate these negative phenomena in order to eliminate the soil of juvenile violent crime. This paper is divided into three parts, a total of more than 31000 words. The first part is the evolution and development trend of juvenile violent crime in Shanghai. According to the chronological order, this paper reviews the transformation of the types of juvenile violent crimes in Shanghai, the increase of the number of crimes and the changes in the nature of crimes, and completely expounds the evolution of juvenile violent crimes in Shanghai. The development trend of juvenile violent crime in Shanghai is analyzed from many angles, such as the number of crimes, the type of crime, the subject of crime, the form of criminal organization, the means of crime, the place where the crime occurred, and the cause of the crime. The second part is the analysis of the reasons for the evolution of juvenile violent crime in Shanghai. According to the characteristics of the subject of juvenile violent crime in Shanghai, the particularity of behavior and the characteristics of Shanghai metropolis, this paper analyzes the factors of teenagers themselves. This paper focuses on the analysis of the personality defects of teenagers and the shortcomings of world outlook and outlook on life. In the analysis of social factors, in addition to political background, economic development, family, school, community and other factors, the impact of Shanghai in the process of urbanization is analyzed. The third part is the countermeasures of prevention and control of juvenile violent crime in Shanghai. This paper first reviews the prevention and treatment of juvenile violent crimes in Shanghai through legislation, judicature and comprehensive management. Then it puts forward some countermeasures from the aspects of social factors that are easy to cause the tendency of juvenile violent crime in society, family and school, through strengthening family education, doing a good job in school education, purifying the mass media and eliminating ugly phenomena. To strengthen the management of the floating population, in particular to firmly establish and practice the socialist concept of honor and disgrace, so as to create a good atmosphere suitable for the development of young people, so that we can minimize and eliminate violent crimes committed by young people, Control juvenile violent crimes within a certain range and effectively maintain a stable social situation.
