【摘要】：正2009年1月6日,廣東省檢察院對外公布幫助企業(yè)解困促進(jìn)企業(yè)發(fā)展的"十條意見"以及"以受理涉及企業(yè)舉報(bào)線索的六不準(zhǔn)",意見明確規(guī)定,查辦企業(yè)經(jīng)營管理者和關(guān)鍵崗位工作人員的職務(wù)犯罪案件,檢察機(jī)關(guān)要及時(shí)與主管部門或企業(yè)領(lǐng)導(dǎo)溝通,慎重選擇辦案時(shí)機(jī),犯罪情節(jié)輕微的,酌情暫緩辦理。對涉嫌犯罪的企業(yè)特別是目前仍在營運(yùn)的困難企業(yè),要慎用查封、扣押、凍結(jié)等措施;對企業(yè)法定代表人、生產(chǎn)經(jīng)營負(fù)責(zé)人和技術(shù)業(yè)務(wù)骨干,涉嫌一般犯
[Abstract]:On January 6, 2009, the Guangdong Provincial Procuratorate announced to the outside world the "ten opinions" on helping enterprises to extricate themselves from difficulties and promote the development of enterprises, as well as "six injunctions in order to accept clues related to enterprise reports," the opinions clearly stipulated. In investigating and handling cases of duty crimes committed by enterprise managers and staff members in key positions, the procuratorial organs shall communicate with the competent departments or enterprise leaders in a timely manner, carefully choose the timing of handling the cases, and if the circumstances of the crimes are minor, suspend the handling of the cases as appropriate. For enterprises suspected of committing crimes, especially those that are still operating at present, measures such as seizure, seizure and freezing should be carefully used; for the legal representatives of enterprises, the responsible persons in charge of production and operation and the backbone of technical business, they should be suspected of committing general crimes.
