【摘要】： 本文立足于打擊賄賂犯罪的現(xiàn)實(shí)需要,對(duì)我國賄賂犯罪現(xiàn)狀、特點(diǎn)、原因以及賄賂犯罪爭議問題、相關(guān)立法的缺陷與局限進(jìn)行理性分析,并汲取國內(nèi)外刑法學(xué)界尤其是《聯(lián)合國反腐敗公約》的理論精髓,提出了完善我國賄賂犯罪刑事立法的構(gòu)想。本文針對(duì)當(dāng)前賄賂犯罪查處的現(xiàn)狀,提出了強(qiáng)化偵查賄賂犯罪構(gòu)想,同時(shí)本文在宏觀層面提出防范賄賂犯罪對(duì)策。 全文共分為四個(gè)部分。第一部分主要論述當(dāng)前我國賄賂犯罪現(xiàn)狀及其腐敗犯罪的特點(diǎn),并且從經(jīng)濟(jì)、政治、思想觀念以及社會(huì)歷史和現(xiàn)實(shí)的等因素分析了賄賂犯罪產(chǎn)生原因的。第二部分從賄賂犯罪爭議問題入手,對(duì)賄賂犯罪立法進(jìn)行研究,同時(shí)借鑒《聯(lián)合國反腐敗公約》精神,提出了完善我國賄賂犯罪刑事立法的初步設(shè)想。第三部分闡述強(qiáng)化刑事司法在防范賄賂犯罪中的作用。第四部分闡述了防范賄賂犯罪,必須通過素質(zhì)教育、完善機(jī)制、健全法制入手,通過宏觀上進(jìn)行防范對(duì)策設(shè)計(jì)。
[Abstract]:Based on the realistic needs of cracking down on bribery crime, this paper makes a rational analysis of the present situation, characteristics, causes, controversial issues of bribery crime, and the defects and limitations of relevant legislation in our country. Based on the theoretical essence of domestic and foreign criminal law circles, especially the United Nations Convention against Corruption, this paper puts forward the idea of perfecting the criminal legislation of bribery crime in China. In view of the present situation of investigation and punishment of bribery crime, this paper puts forward the idea of strengthening the investigation of bribery crime, and puts forward some countermeasures to prevent bribery crime at the macro level. The full text is divided into four parts. The first part mainly discusses the current situation of bribery crime in our country and the characteristics of corruption crime, and analyzes the causes of bribery crime from the aspects of economy, politics, ideology, social history and reality. The second part starts with the controversial issue of bribery crime, studies the legislation of bribery crime, and draws lessons from the spirit of the United Nations Convention against Corruption, and puts forward a preliminary idea of perfecting the criminal legislation of bribery crime in our country. The third part expounds the role of strengthening criminal justice in preventing bribery crime. The fourth part expounds that the prevention of bribery crime must be carried out through quality education, perfect mechanism, perfect legal system, and design preventive countermeasures from a macro point of view.
