【摘要】：黑社會(huì)性質(zhì)犯罪滋生蔓延的社會(huì)基礎(chǔ)是 :腐敗問(wèn)題嚴(yán)重 ,執(zhí)法不嚴(yán) ,打擊不力 ,使黑社會(huì)性質(zhì)犯罪趁隙而起 ;私有制的發(fā)展為滋生黑社會(huì)性質(zhì)犯罪提供了經(jīng)濟(jì)基礎(chǔ) ;刑事案件增多與團(tuán)伙犯罪上升是黑社會(huì)性質(zhì)犯罪的重要前提 ;黑社會(huì)性質(zhì)犯罪隨著經(jīng)濟(jì)罪案的大幅上升而滋生 ;黃賭毒成為黑社會(huì)性質(zhì)犯罪的重要溫床和土壤 ;特殊的地理人文景觀對(duì)黑社會(huì)性質(zhì)犯罪發(fā)展產(chǎn)生巨大的影響 ;不可忽視的歷史因素是滋生黑社會(huì)性質(zhì)犯罪的重要因素。治理對(duì)策是 :貫徹刑法有關(guān)規(guī)定 ,嚴(yán)密有關(guān)法律條文 ;公安工作必須把反黑斗爭(zhēng)擺上重要議事日程 ;堅(jiān)持嚴(yán)打方針 ,強(qiáng)化治安管理 ;從宏觀對(duì)策上加強(qiáng)預(yù)防
[Abstract]:The social basis of the breeding and spreading of triad crime is as follows: corruption is serious, law enforcement is not strict, and the crackdown is not effective, so that the crime of triad nature takes advantage of the gap; The development of private ownership provides the economic basis for the breeding of triad crime, the increase of criminal cases and the rise of gang crime is the important premise of triad-like crime, and the triad-like crime grows with the increase of economic crime. Yellow gambling poison has become an important hotbed and soil for crime of triad nature; special geographical and humanistic landscape has a great influence on the development of crime of triad nature; historical factors that can not be ignored are important factors that breed crime of triad nature. The countermeasures are: to carry out the relevant provisions of the criminal law and to tighten the relevant legal provisions; to put the anti-triad struggle on the important agenda of the public security work; to adhere to the principle of strike hard, to strengthen the administration of public security; and to strengthen the prevention from the macro-countermeasures.
