【摘要】：警察職務(wù)犯罪是指人民警察在執(zhí)行警察職務(wù)的過程中,侵犯國家對(duì)警察職務(wù)管理法律的規(guī)定,并依法應(yīng)受到刑罰處罰的行為。近年來,我國頻發(fā)警察職務(wù)犯罪案件,并且數(shù)量呈現(xiàn)出上升趨勢。褻瀆了國家賦予警察的神圣權(quán)力,疏離了人們對(duì)社會(huì)基本價(jià)值的信仰,嚴(yán)重影響了警民關(guān)系。由于警察職務(wù)犯罪不同于其他類型的犯罪,對(duì)警察職務(wù)犯罪的危害性的認(rèn)識(shí)比較困難。同其他犯罪相比具有如下特點(diǎn):一是職務(wù)犯罪危害的掩蓋性。二是警察職務(wù)犯罪危害的深遠(yuǎn)性。三是警察職務(wù)犯罪危害的多重性。警察職務(wù)犯罪有客觀和主觀兩個(gè)方面的原因�？陀^原因包括政治因素,警察權(quán)力的異化是警察職務(wù)犯罪產(chǎn)生的一個(gè)重要政治因素。制度因素,我國的一些警察制度在可操作性方面還存在著一些缺陷,沒有形成切實(shí)有效的制度體系。主觀因素包括警察個(gè)人心理問題,不恰當(dāng)?shù)恼J(rèn)識(shí)和消極的人生觀等方面。警察職務(wù)犯罪的可致性、因果性規(guī)律性可以得出警察職務(wù)犯罪的預(yù)防具有可行性。在警察職務(wù)犯罪預(yù)防方面的具體措施主要通過完善現(xiàn)有的法律制度,警察管理制度。通過教育預(yù)防使警察樹立正確的人生觀和價(jià)值觀,并根據(jù)警察職業(yè)的心理問題提出有針對(duì)性的心理預(yù)防措施。公民、媒體和公安機(jī)關(guān)內(nèi)部要做好監(jiān)督工作,督察人民警察依法履行職責(zé),有效防止警察職務(wù)犯罪的發(fā)生。
[Abstract]:Police duty crime refers to the people's police in the process of performing police duties in the process of violating the state of police duty management laws, and should be punished in accordance with the law. In recent years, there are frequent cases of police duty crimes in our country, and the number of them is on the rise. It desecrates the sacred power given by the state, alienates people's belief in the basic values of society, and seriously affects the relationship between the police and the people. Because police duty crime is different from other types of crime, it is difficult to understand the harmfulness of police duty crime. Compared with other crimes, it has the following characteristics: first, the cover of the harm of duty crime. The second is the deep-range nature of the harm caused by the crime of police duty. The third is the multiplicity of the harms of police duty crimes. Police duty crimes have both objective and subjective reasons. Objective reasons include political factors, the alienation of police power is an important political factor of police duty crime. There are still some defects in the maneuverability of some police system in our country, and no effective system has been formed. Subjective factors include police personal psychological problems, inappropriate understanding and negative outlook on life and so on. The regularity of causation and causality of police duty crime can be concluded that the prevention of police duty crime is feasible. The concrete measures in the police duty crime prevention mainly through the improvement of the existing legal system, police management system. By means of educational prevention, the police should establish a correct outlook on life and values, and put forward targeted psychological preventive measures according to the psychological problems of the police profession. Citizens, media and public security organs should supervise and supervise the people's police in accordance with the law to effectively prevent the occurrence of police duty crimes.
