【摘要】：隨著我國經濟的快速增長及人民生活水平的提高，機動車和駕駛人數量也在快速增長，道路交通事故引發(fā)的矛盾糾紛數量逐年上升，因對處理結果不滿意的事故次數也相應增加,雙方當事人容易激化矛盾，進而引發(fā)的群體性堵路、上訪案件時有發(fā)生，對當地人民群眾的生產生活、社會穩(wěn)定造成不良影響，因此，道路交通事故調解工作也逐步成為社會普遍關注的熱點問題。 道路交通事故調解工作也逐步成為社會普遍關注的熱點問題，調解是需要雙方當事人的合意的，只有雙方當事人一致同意調解才可能進行，因此，必須由一方當事人首先提出愿意調解的意向，并經另一方當事人認同，才有可能會有下一步的調解工作，但在實踐中，提出調解意愿的一方當事人往往不會親自向對方當事人提出，因為即使向對方當事人主動提出調解要求，也很難得到對方的響應，反而會讓對方當事人誤解為自己一方占有道理，占住強勢地位，從某種程度上反而會促使對方當事人抵制調解的意向加強，而交警部門因警力不足，缺乏專業(yè)調解經驗，存在相當一部分案件無法成功調解，因此，專業(yè)社工介入交通事故調解工作，運用專業(yè)的工作方法和技能對事故雙方當事人進行調解，是當前轉型時期道路交通事故調解工作的有益補充，本文結合在道路交通事故糾紛調解工作的實際，對社會工作者介入道路交通事故糾紛調解工作的可行性和可操作性進行初步探討，目的是通過社會工作者的介入，進一步提高道路交通事故糾紛調解率，提升當事人對糾紛解決結果的滿意度，，最大限度地促進社會和諧。
[Abstract]:With the rapid growth of China's economy and the improvement of people's living standards, the number of motor vehicles and drivers is also growing rapidly, and the number of contradictions and disputes caused by road traffic accidents is increasing year by year. As a result of the corresponding increase in the number of accidents that are not satisfied with the handling results, the parties on both sides are prone to exacerbate contradictions, thereby causing mass road blockages, and petitioning cases occur from time to time, causing adverse effects on the production and life of the local people and on the social stability of the local people. Therefore, the mediation of road traffic accidents has gradually become a hot issue of social concern. Mediation of road traffic accidents has gradually become a hot issue of general concern in the society. Mediation requires the consent of both parties, and only with the unanimous consent of both parties can mediation be carried out. It is only if one of the parties first expresses their intention to conciliate and agrees with the other party that there is a possibility that there will be a next step in conciliation work, but in practice, A party who wishes to conciliate often does not bring it to the other party in person, because it is difficult to get a response from the other party even if the request for conciliation is made to the other party on its own initiative. On the contrary, the opposite party will be misunderstood as their own party has reason, occupy a strong position, to some extent will urge the other party to resist mediation intention to strengthen, and the traffic police department due to lack of police force, lack of professional mediation experience, There are quite a number of cases that cannot be successfully mediated. Therefore, professional social workers are involved in the mediation of traffic accidents and use professional working methods and skills to mediate the parties to the accident. It is a useful supplement to the mediation work of road traffic accident in the current transition period. This article combines the reality of the mediation work of road traffic accident dispute. This paper discusses the feasibility and maneuverability of social workers involved in the mediation of road traffic accident disputes, in order to further improve the mediation rate of road traffic accidents disputes through the intervention of social workers. Improve the satisfaction of the parties to the outcome of dispute resolution, maximize the promotion of social harmony.
