【摘要】：中國(guó)現(xiàn)行的戶籍制度是“東方專制主義的單一性”與計(jì)劃經(jīng)濟(jì)緊密結(jié)合的產(chǎn)物,其中所包含的二元戶籍制和限制遷徙自由的制度是對(duì)人類平等、自由的嚴(yán)重侵犯。該制度運(yùn)行近半個(gè)世紀(jì),它的統(tǒng)治意識(shí)已滲入了幾代人的思維模式,禁錮了法治思想的發(fā)展。目前其依然在社會(huì)主義市場(chǎng)經(jīng)濟(jì)體制中施行,其危害不僅是對(duì)人權(quán)的侵犯,而是對(duì)整個(gè)社會(huì)的文明和進(jìn)步的阻撓和摧殘。 中國(guó)現(xiàn)行戶籍制度的改革是法治社會(huì)發(fā)展的必然趨勢(shì),其改革的目標(biāo)是在憲法上重新確立遷徙自由、取消二元戶籍制度和消除附加在戶籍上的各種利益,還戶籍本來(lái)的面目。 現(xiàn)行戶籍制度的改革不僅是對(duì)一個(gè)法律的修改和一種管理制度的變革,它會(huì)體現(xiàn)出的政府對(duì)人的關(guān)懷、體現(xiàn)出政府對(duì)法治的認(rèn)識(shí)和對(duì)法治思想的認(rèn)可和鼓勵(lì)。戶籍制度的改革會(huì)使現(xiàn)代的人們?cè)谒枷胍庾R(shí)中產(chǎn)生巨大的沖擊,將打碎禁錮人們多年的精神枷鎖,使法治思想深入人心,它會(huì)激發(fā)出人們無(wú)窮的創(chuàng)造力和積極的競(jìng)爭(zhēng)意識(shí),這是社會(huì)主義市場(chǎng)經(jīng)濟(jì)對(duì)主體和制度的必然要求,也是走向法治社會(huì)的必經(jīng)之路。 現(xiàn)行戶籍制度的改革是中國(guó)法治進(jìn)程中的一個(gè)里程碑,是中國(guó)政治文明的一大飛躍,它的實(shí)現(xiàn)將代表一個(gè)嶄新的民主政治時(shí)代的到來(lái)。
[Abstract]:The current household registration system in China is the result of the close combination of the monosonicity of oriental dictatorship and planned economy, which includes the dual domicile system and the system of restricting freedom of movement, which is a serious violation of human equality and freedom. For nearly half a century, its ruling consciousness has infiltrated into the thinking mode of several generations and confined the development of the thought of rule of law. At present, it is still carried out in the socialist market economy system, and its harm is not only the violation of human rights, but also the obstruction and destruction of the civilization and progress of the whole society. The reform of the current household registration system in China is the inevitable trend of the development of the society ruled by law. The goal of the reform is to re-establish the freedom of movement in the constitution, abolish the dual household registration system and eliminate the various interests attached to the household registration system, and return the household registration system to the original face of the household registration system. The reform of the current household registration system is not only a revision of a law and a reform of a management system, it will reflect the government's concern for people, the government's understanding of the rule of law and the recognition and encouragement of the thought of the rule of law. The reform of the household registration system will make the modern people have a huge impact in their ideological consciousness, will break the spiritual shackles that have imprisoned people for many years, and make the thought of rule of law deeply rooted in the hearts of the people. It will stimulate people's infinite creativity and positive sense of competition. This is the inevitable requirement of socialist market economy to the subject and system, and it is also the only way to go to the rule of law society. The reform of the current household registration system is a milestone in the process of China's rule of law and a great leap forward in China's political civilization. Its realization will represent the arrival of a brand-new democratic political era.
