【摘要】：由于司法傳統(tǒng)和社會(huì)文化背景的不同 ,現(xiàn)代各國(guó)的偵查程序可以分為不同的模式。根據(jù)偵、辯雙方在程序中的地位和關(guān)系 ,可以將其劃分為對(duì)抗式偵查模式和職權(quán)式偵查模式 ;根據(jù)偵、辯、審三方的關(guān)系即偵查程序是否受法院即司法的控制 ,又可以將其區(qū)分為司法型偵查模式與行政型偵查模式。由于歷史和現(xiàn)實(shí)的原因 ,我國(guó)現(xiàn)行的偵查程序采行的是職權(quán)式偵查模式 ,同時(shí)更是一種行政型偵查模式 ,偵查程序改革的關(guān)鍵就是要實(shí)現(xiàn)偵查模式的結(jié)構(gòu)轉(zhuǎn)型。
[Abstract]:Due to the different judicial tradition and social and cultural background, the investigation procedure in modern countries can be divided into different models. According to the investigation, the position and relationship of the two parties in the procedure can be divided into adversarial investigation mode and duty investigation mode; According to the relationship between investigation, defense and trial, that is, whether the investigation procedure is controlled by the court or not, it can also be divided into judicial investigation mode and administrative investigation mode. Due to historical and practical reasons, the current investigation procedure in our country adopts the mode of investigation with power of duty, at the same time, it is also an administrative mode of investigation. The key to the reform of the procedure of investigation is to realize the structural transformation of the pattern of investigation.
