司法鑒定責(zé)任制度研究

【摘要】： 司法鑒定責(zé)任制度是司法鑒定制度的組成部分,也是司法程序中的組成部分。我國司法鑒定責(zé)任制度很不完善。建立與完善司法鑒定責(zé)任制度,對(duì)于推動(dòng)司法改革,深化人們對(duì)司法鑒定科學(xué)性的認(rèn)識(shí)、促進(jìn)鑒定科學(xué)的發(fā)展和技術(shù)水平的提高,強(qiáng)化鑒定人責(zé)任心,對(duì)因錯(cuò)誤鑒定而遭受損失的受害者進(jìn)行救濟(jì)、維護(hù)當(dāng)事人合法權(quán)益都具有十分重要的意義。 本文首先從司法鑒定的概念出發(fā),指出建立和完善司法鑒定責(zé)任制度的重要意義;其次,系統(tǒng)分析了司法鑒定法律責(zé)任的責(zé)任類型,重點(diǎn)論述了司法鑒定的民事責(zé)任;然后,綜合前兩章的論述,筆者在分析我國司法鑒定責(zé)任制度的現(xiàn)狀中提出了幾個(gè)現(xiàn)存問題;最后,針對(duì)我國的現(xiàn)狀,提出了完善我國司法鑒定責(zé)任制度的構(gòu)想和一些配套措施,以期對(duì)我國司法鑒定責(zé)任制度的建構(gòu)有所幫助。
[Abstract]:Judicial expertise liability system is a part of judicial identification system, but also a part of judicial procedures. The system of judicial expertise liability in our country is not perfect. The establishment and perfection of the system of judicial expertise responsibility will promote the judicial reform, deepen people's understanding of the scientific nature of judicial expertise, promote the development of forensic science and the improvement of technical level, and strengthen the sense of responsibility of the appraiser. It is of great significance to remedy the victims who suffer from the loss due to the wrong identification and to safeguard the legitimate rights and interests of the parties. Starting from the concept of judicial expertise, this paper points out the importance of establishing and perfecting the system of judicial expertise liability, secondly, it systematically analyzes the types of legal liability of judicial expertise, focusing on the civil liability of judicial expertise; Then, based on the discussion of the first two chapters, the author puts forward some existing problems in the analysis of the status quo of the judicial expertise liability system in China. Finally, according to the present situation of our country, this paper puts forward the conception of perfecting the responsibility system of judicial expertise in our country and some supporting measures, in order to help the construction of the responsibility system of judicial expertise in our country.
