【摘要】：進(jìn)行手機(jī)短信詐騙的犯罪者主要利用了科學(xué)技術(shù)發(fā)展之后,公眾缺乏對相關(guān)信息的了解和掌握信息的不對稱,以及處于社會轉(zhuǎn)型時期法律和現(xiàn)實(shí)之間的空隙;此外,社會治理程度不夠也為該類犯罪制造了機(jī)會,如對流動人口的管理松散,現(xiàn)金結(jié)算制度不規(guī)范等。針對導(dǎo)致該類犯罪的多重因素,有效治理此類犯罪,除了立法完善,技術(shù)跟進(jìn)以外,可以引入資格刑,而且更應(yīng)該加強(qiáng)社會治理。
[Abstract]:After the development of science and technology, the perpetrators of short message fraud mainly take advantage of the development of science and technology, the lack of public understanding of relevant information and the asymmetry of information, as well as the gap between law and reality in the period of social transformation; In addition, the insufficient level of social governance also creates opportunities for this type of crime, such as loose management of the floating population, irregular cash settlement system and so on. In view of the multiple factors that lead to this kind of crime, the effective management of this kind of crime, in addition to perfect legislation, technical follow-up, can introduce qualification punishment, and should strengthen social governance.
