【摘要】：犯罪有“促進(jìn)社會(huì)”功能的觀點(diǎn),誤導(dǎo)了學(xué)術(shù)研究,使犯罪有益論悄然興起,將研究 引入了歧途。犯罪功能分析引出有“促進(jìn)社會(huì)”功能的結(jié)論是荒謬的,荒謬的原因是單純地把犯罪功能 看作是客觀反應(yīng)的現(xiàn)象,是事物的刺激因素,把受刺激事物的反應(yīng)看作是其功能,導(dǎo)致了功能與其蘊(yùn)涵的 事物分離的二元論,有違于功能的原意。功能屬于總體活動(dòng)中部分活動(dòng)對(duì)總體活動(dòng)所作的貢獻(xiàn)。功能分析 通過考察社會(huì)要達(dá)到的目的或目標(biāo)來解釋社會(huì)活動(dòng),而不象犯罪功能分析者那樣,脫離犯罪目的和目標(biāo), 通過犯罪者意料之外的結(jié)果考察犯罪,因而也導(dǎo)致了結(jié)論的荒謬。
[Abstract]:The view that crime has the function of "promoting society" misleads academic research, causes the crime beneficial theory to rise quietly, and leads the research astray. The analysis of criminal function leads to the conclusion that the function of "promoting society" is absurd. The absurd reason is that the criminal function is regarded as the phenomenon of objective reaction, is the stimulus factor of things, and the reaction of stimulated thing is regarded as its function. The dualism that leads to the separation of function from the things it contains is contrary to the original intention of function. The function belongs to the contribution of some activities to the overall activities. Functional analysis explains social activities by examining the goals or objectives to be achieved by society, unlike the criminal function analysts, who are divorced from the purposes and objectives of the crime, and examine the crime through the unexpected results of the offenders. This leads to the absurdity of the conclusion.
