【摘要】：法治本質(zhì)上是對(duì)權(quán)力的限制,執(zhí)法腐敗會(huì)從源頭上污染法治之水。公安腐敗現(xiàn)象的主因是制約機(jī)制不完善。公安機(jī)關(guān)的本質(zhì)屬性當(dāng)屬執(zhí)法機(jī)構(gòu),并具有明顯的司法色彩,行政性乃附屬。對(duì)公安機(jī)關(guān)的監(jiān)督主體、方式、目的以及程序設(shè)計(jì)都應(yīng)當(dāng)與行政機(jī)關(guān)有所不同。對(duì)公安機(jī)關(guān)的監(jiān)督主體當(dāng)以司法和警務(wù)督察為主,以公開(kāi)庭審為主要方式,以維護(hù)公正執(zhí)法為目的,以細(xì)化的程序?yàn)楸Ｕ?以他律為依托。但目前的體制偏向于行政權(quán)力運(yùn)轉(zhuǎn),執(zhí)法性不鮮明,對(duì)執(zhí)法權(quán)的監(jiān)督混同于對(duì)普通行政權(quán)的監(jiān)督。要改革現(xiàn)有的督察機(jī)構(gòu)體制,組建由公安部督察委員會(huì)垂直領(lǐng)導(dǎo)的督察體制,這不僅是國(guó)外、境外警察監(jiān)督機(jī)制經(jīng)驗(yàn)的啟示,也是當(dāng)前形勢(shì)發(fā)展的必然選擇。
[Abstract]:In essence, the rule of law is the restriction of power, and the corruption of law enforcement will pollute the water of the rule of law from the source. The main reason of public security corruption is that the restriction mechanism is not perfect. The essential attribute of public security organs should be law enforcement agencies, and have obvious judicial color, administrative nature is subsidiary. The supervision subject, mode, purpose and program design of the public security organ should be different from that of the administrative organ. The supervision subject of the public security organ should be mainly judicial and police inspector, the main way is open trial, the purpose is to maintain the fair law enforcement, the detailed procedure is the guarantee, and the other law is the basis. However, the current system is biased towards the operation of administrative power, and the law enforcement is not clear. The supervision of law enforcement is mixed with the supervision of ordinary administrative power. It is not only the inspiration of the experience of the foreign and overseas police supervision mechanism, but also the inevitable choice of the current situation to reform the present supervision system and set up the supervision system under the vertical leadership of the Supervision Committee of the Ministry of Public Security.
