【摘要】：誘惑偵查是指偵查人員及其他參與偵查活動(dòng)的人員通過誘惑性方式誘使某人實(shí)施犯罪行為或促使犯罪行為暴露的一種偵查手段。誘惑偵查有多種分類方法 ,較為流行的是將其分為“機(jī)會(huì)提供型”和“犯罪誘發(fā)型”兩類。誘惑偵查可以在合法的范圍內(nèi)使用 ,但也可能被違法地使用 ,因此 ,不宜籠統(tǒng)地將其視為非法而予以排斥 ,但要對(duì)其進(jìn)行必要的規(guī)范和制約。將誘惑偵查限定在無被害人案件 ,似乎范圍過窄。誘惑偵查只能針對(duì)已有犯罪意圖并正在尋機(jī)作案或可能繼續(xù)犯罪的人采用。由于誘惑偵查適用的案件類型較為多樣 ,所以其策略方法也是靈活多樣的。
[Abstract]:Enticement investigation is a kind of investigative technique which induces someone to commit a criminal act or induces the criminal behavior to be exposed by means of enticement by the investigators and other persons who participate in the investigation. There are many kinds of classification methods for enticement investigation, which are divided into two types: "opportunity providing type" and "crime inducing type". Temptation detection can be used in the legal scope, but it may also be used illegally. Therefore, it should not be generally regarded as illegal and excluded, but it should be regulated and restricted. It seems too narrow to limit the enticement investigation to the case of no victim. Seductive detection can only be used against persons with criminal intent who are looking for an opportunity or who may continue to commit a crime. Because the types of cases suitable for seductive investigation are various, so its tactics and methods are flexible and diverse.
