公安經(jīng)偵協(xié)作機制研究

【摘要】： 當(dāng)前,隨著我國社會主義市場經(jīng)濟的快速發(fā)展,經(jīng)濟犯罪呈逐年上升趨勢,且犯罪手段不斷翻新、犯罪性質(zhì)越發(fā)惡劣。公安經(jīng)偵部門作為打擊經(jīng)濟犯罪的主力軍、前頭兵,面臨的形勢和任務(wù)將更加艱巨和復(fù)雜,經(jīng)濟犯罪偵查工作在實踐中面臨的困難也日益增大,各地公安機關(guān)的經(jīng)偵協(xié)作遇到許多難點問題亟需解決。 公安經(jīng)偵部門要做到充分發(fā)揮本身的職能作用,積極應(yīng)對經(jīng)濟快速全球化進程下,經(jīng)濟犯罪逐步向高科技、智能化方向發(fā)展以及跨區(qū)域流動作案日益增多的趨勢,同時,加大對經(jīng)濟犯罪的打擊力度,從源頭上遏制經(jīng)濟犯罪活動的高發(fā)態(tài)勢,將經(jīng)濟犯罪活動消除于萌芽狀態(tài),實現(xiàn)經(jīng)偵工作向可防型、可控型戰(zhàn)略轉(zhuǎn)變,其途徑之一就是探索建立打擊和防范經(jīng)濟犯罪的協(xié)作機制。在此形勢下,如何從經(jīng)偵協(xié)作制度、機制、內(nèi)容上對現(xiàn)有經(jīng)偵協(xié)作實行優(yōu)化,已上升為公安經(jīng)偵部門職能的核心內(nèi)容。因此,無論是從經(jīng)濟犯罪活動規(guī)律特點的演變態(tài)勢看,還是從打擊經(jīng)濟犯罪的實踐需要看,建立與各部門各單位全方位、多層次、高效運行的協(xié)作機制便成為歷史的必然選擇。 本文是結(jié)合公安管理實踐經(jīng)驗,從公共管理學(xué)的角度對公安經(jīng)偵協(xié)作機制理論建設(shè)所做的一些探討。文章從研究公安經(jīng)偵協(xié)作的概念、獨特性質(zhì)及研究對象入手,引入文章主題,即公安經(jīng)偵協(xié)作機制;而后運用歷史研究、案例分析、比較研究等方法,回顧了中外經(jīng)偵協(xié)作機制建設(shè)的發(fā)展進程,發(fā)現(xiàn)了當(dāng)前公安經(jīng)偵協(xié)作機制建設(shè)中存在的互相推諉、各自為政、有罪不究、以罰代刑、工作隨意、程序脫節(jié)、重管理輕服務(wù)、打防脫節(jié)等現(xiàn)狀和協(xié)作動因、方式、程序、內(nèi)容的局限性,在此基礎(chǔ)上分析了公安經(jīng)偵協(xié)作機制建設(shè)問題產(chǎn)生的內(nèi)外部原因;最后,運用行政公關(guān)、行政協(xié)調(diào)、管理溝通等管理學(xué)理論,積極探索規(guī)范化、人性化協(xié)作的有效途徑,以期達到優(yōu)化經(jīng)偵部門行政形象與府際關(guān)系的協(xié)作新機制,促進經(jīng)偵協(xié)作機制建設(shè)健康、有序、和諧發(fā)展的目標(biāo)。
[Abstract]:At present, with the rapid development of socialist market economy in our country, the economic crime is on the rise year by year, and the criminal means are constantly renovated, and the nature of the crime is more and more abominable. As the main force in the fight against economic crimes, the public security and economic investigation departments will face more difficult and complicated situations and tasks, and the difficulties faced in the investigation of economic crimes are increasing day by day. The cooperation of local public security organs in economic investigation meets many difficult problems that need to be solved. Public security and economic investigation departments should give full play to their own functions and actively respond to the trend that economic crimes are gradually developing to high-tech, intelligentized and cross-regional mobile crimes under the process of rapid economic globalization. At the same time, To step up efforts to crack down on economic crime, curb the high incidence of economic crime at the source, eliminate economic criminal activity in its infancy, and realize the transformation of economic investigation work to a preventable and controllable strategy. One of its ways is to explore the establishment of a cooperative mechanism to combat and prevent economic crime. Under this situation, how to optimize the existing economic investigation cooperation from the system, mechanism and content of economic investigation has become the core content of the function of public security economic investigation department. Therefore, whether from the evolution of the characteristics of economic criminal activities, or from the practice of cracking down on economic crime, it is an inevitable choice to establish a comprehensive, multi-level and efficient cooperation mechanism with all departments and units. Based on the practical experience of public security management, this paper probes into the theoretical construction of the cooperation mechanism of public security economic investigation from the perspective of public management. Starting with the research of the concept, the unique nature and the research object of the cooperation of public security economic investigation, the article introduces the theme of the article, that is, the cooperation mechanism of public security economic investigation; Then, by means of historical research, case analysis and comparative study, this paper reviews the development process of the construction of the cooperative mechanism of economic investigation between China and foreign countries, and finds out that there is a mutual prevarication in the construction of the cooperative mechanism of public security economic investigation and that there is no investigation of guilt. The present situation and the limitation of cooperation motivation, mode, procedure and content of punishment substitute punishment, work at will, procedure disconnect, management light service, fight against disconnection, etc., on the basis of which, the internal and external reasons for the construction of cooperation mechanism of public security economic investigation and investigation are analyzed. Finally, using administrative public relations, administrative coordination, management communication and other management theories, we actively explore effective ways to standardize and humanize cooperation, in order to optimize the administrative image of the economic investigation department and the new cooperation mechanism between the government and the government. To promote the goal of healthy, orderly and harmonious development of the cooperative mechanism of economic investigation.
