【摘要】： 檢察機(jī)關(guān)擁有職務(wù)犯罪的偵查權(quán),明確檢察機(jī)關(guān)職務(wù)犯罪偵查權(quán)的法理基礎(chǔ),完善對其監(jiān)督制約的方式,對控制犯罪、保障人權(quán)具有重要意義。 本文首先闡明了檢察機(jī)關(guān)職務(wù)犯罪偵查權(quán)的性質(zhì)、特點、法理基礎(chǔ)。然后考察了有關(guān)國家對檢察機(jī)關(guān)職務(wù)犯罪偵查權(quán)的立法狀況,得出共同的特點。接著研究我國對職務(wù)犯罪偵查權(quán)的立法現(xiàn)狀,實證分析了目前存在的問題。在此基礎(chǔ)上,提出完善我國檢察機(jī)關(guān)職務(wù)犯罪偵查權(quán)的價值取向,提出從內(nèi)部完善線索管理、對偵查活動嚴(yán)格監(jiān)督的建議;加大上級檢察機(jī)關(guān)對下級檢察機(jī)關(guān)的監(jiān)督力度,確立投訴復(fù)議機(jī)制;從外部提出確立律師偵查階段的辯護(hù)人地位,完善人民監(jiān)督員權(quán)利,確立錯案質(zhì)詢告知制度等建議。從而達(dá)到追訴犯罪與保障人權(quán)的有機(jī)統(tǒng)一。
[Abstract]:The procuratorial organ has the investigation power of the duty crime, it is of great significance to define the legal basis of the procuratorial organ's duty crime investigation power and perfect the way of supervising and restricting it, which is of great significance to control the crime and protect the human rights. This paper first expounds the nature, characteristics and legal basis of the power to investigate crimes committed by procuratorial organs. Then, the legislative situation of the investigation power of procuratorial organ's duty crime is investigated, and the common characteristics are obtained. Then it studies the legislative status of the investigation power of duty crime in China, and analyzes the existing problems. On this basis, the author puts forward the value orientation of the investigation power of procuratorial organ's duty crime, and puts forward the suggestion of perfecting the clue management from the inside and strictly supervising the investigation activity. We should strengthen the supervision of the procuratorial organs at higher levels, establish the mechanism of complaint review, and put forward some suggestions from the outside, such as establishing the status of counsel in the investigation stage of lawyers, perfecting the rights of people's supervisors, and establishing the system of informing the inquiry of wrong cases. In order to achieve the prosecution of crime and the protection of human rights organic unity.
