中國城管綜合執(zhí)法困境研究

【摘要】：城市化進(jìn)程的加快給我國城市管理部門帶來了巨大的壓力。近年來我國積極探索城市管理體制上的創(chuàng)新，取得了一定的成效。城管綜合執(zhí)法機(jī)構(gòu)是政府為了更好的進(jìn)行城市事物的管理而專門設(shè)置的，它是城市中多種職能部門的有機(jī)整合，能夠有效解決經(jīng)濟(jì)社會發(fā)展過程中涌現(xiàn)的權(quán)力膨脹和多頭執(zhí)法等問題，并應(yīng)對經(jīng)濟(jì)社會發(fā)展過程中不斷出現(xiàn)的新情況和新問題。然而在不斷摸索和實(shí)踐的過程中，城管綜合執(zhí)法機(jī)構(gòu)也遭遇到了一些內(nèi)外部困境。 本文采用理論分析和案例研究相結(jié)合的方法，結(jié)合治理與善治理論、多中心治理理論、博弈論等，對城管執(zhí)法過程中所遇到的困境，產(chǎn)生困境的原因以及脫離困境的方法進(jìn)行了具體的闡述。分析出城管執(zhí)法人員在執(zhí)法的過程中遭遇到的困境主要有無法可依和主體地位不明確的法律尷尬；執(zhí)法人員的素質(zhì)與執(zhí)法要求間存在著道德、素質(zhì)和心理上的差距；執(zhí)法主體和客體間存在著客觀不可避免的沖突和主觀人為的沖突；執(zhí)法政策目標(biāo)與政策支持不相適應(yīng)等。在對困境進(jìn)行深入剖析之后得出產(chǎn)生困境的原因主要有一是城市管理理念的偏頗，主要表現(xiàn)在執(zhí)法觀念落后和執(zhí)法方式不當(dāng)上；二是政府配套機(jī)制與社會保障機(jī)制的不完善；三是城管綜合執(zhí)法機(jī)制的不健全，具體分為相關(guān)部門監(jiān)管不力和社會監(jiān)督機(jī)制不完善兩方面來考慮。要擺脫這些困境，可以從明確執(zhí)法部門的法律地位和執(zhí)法依據(jù)；加強(qiáng)城管執(zhí)法隊(duì)伍的自身建設(shè)；加強(qiáng)城管部門與各階層之間的溝通；營造良好的城管執(zhí)法社會環(huán)境四個(gè)方面入手。
[Abstract]:The acceleration of urbanization has brought great pressure to the urban management department in our country. In recent years, China has actively explored the innovation of urban management system, and achieved certain results. The comprehensive law enforcement agency of urban management is specially set up by the government for better management of urban affairs. It is an organic integration of various functional departments in the city. It can effectively solve the problems of power expansion and multiple law enforcement in the process of economic and social development, and deal with the new situation and new problems in the process of economic and social development. However, in the process of continuous exploration and practice, urban management comprehensive law enforcement agencies also encountered some internal and external difficulties. This paper adopts the method of combining theory analysis and case study, combining governance and good governance theory, multi-center governance theory, game theory and so on, to the difficulties encountered in the process of urban management law enforcement. The causes of the predicament and the method of getting out of it are expounded in detail. It is found that the dilemma encountered by urban management law enforcement personnel in the process of enforcing the law is mainly the embarrassment of law which cannot be followed and the status of the principal body is not clear, and there are moral, quality and psychological gaps between the quality of law enforcement personnel and the requirements of law enforcement. There are inevitable and subjective conflicts between the subject and object of law enforcement, and the objectives of law enforcement policy are not suitable for policy support. After the deep analysis of the predicament, it is found that the main reasons for the dilemma are the bias of the urban management concept, the backward concept of law enforcement and the improper way of law enforcement, the second is the imperfection of the supporting mechanism of the government and the mechanism of social security. Thirdly, the comprehensive law enforcement mechanism of urban management is not perfect, which can be divided into two aspects: weak supervision by relevant departments and imperfect social supervision mechanism. To get rid of these difficulties, we can make clear the legal status and law enforcement basis of the law enforcement department, strengthen the self-construction of the urban management law enforcement team, strengthen the communication between the urban management department and the various strata; To create a good urban management law enforcement social environment four aspects.
