【摘要】： 勞動(dòng)教養(yǎng)制度是一項(xiàng)極具中國特色的法律制度,它對(duì)于我國維護(hù)社會(huì)穩(wěn)定、預(yù)防和減少違法犯罪、鞏固國家政權(quán)等發(fā)揮了重要作用。但隨著我國社會(huì)主義民主與法治建設(shè)的逐步完善,勞動(dòng)教養(yǎng)制度的改革與完善成為論爭(zhēng)的熱點(diǎn)問題之一。在將勞教制度改革為違法行為教育矯治制度的發(fā)展方向上,仍然有一些基礎(chǔ)理論問題需要探索和明確,而勞動(dòng)教養(yǎng)監(jiān)督問題則屬于其中重點(diǎn)之 本文圍繞勞動(dòng)教養(yǎng)監(jiān)督的發(fā)展、勞動(dòng)教養(yǎng)監(jiān)督存在的缺陷、勞動(dòng)教養(yǎng)監(jiān)督的法理基礎(chǔ)與法律原則、勞動(dòng)教養(yǎng)監(jiān)督的改革完善與創(chuàng)新展開分析與討論。從勞動(dòng)教養(yǎng)監(jiān)督的含義、功能、建立和發(fā)展現(xiàn)狀來說,我國勞動(dòng)教養(yǎng)監(jiān)督不斷完善同時(shí)又亟需改進(jìn),監(jiān)督意識(shí)、監(jiān)督機(jī)制、審批監(jiān)督、執(zhí)行監(jiān)督等各方面存在著明顯的缺陷。本文認(rèn)為,勞動(dòng)教養(yǎng)監(jiān)督的改革完善,必須適應(yīng)勞動(dòng)教養(yǎng)監(jiān)督主體的多樣性、對(duì)象的特定性、內(nèi)容的廣泛性、形式的規(guī)范性和作用的雙重性特點(diǎn),明確科學(xué)、程序、協(xié)調(diào)、效能、獨(dú)立、民主、責(zé)任的法律原則。從監(jiān)督理念、檢察監(jiān)督、強(qiáng)化功能和完善內(nèi)部監(jiān)督等幾個(gè)方面對(duì)我國現(xiàn)行勞動(dòng)教養(yǎng)監(jiān)督進(jìn)行全方位的革新,以期建構(gòu)一個(gè)符合我國法治化要求的勞動(dòng)教養(yǎng)監(jiān)督制度。
[Abstract]:The system of reeducation through labor is a legal system with Chinese characteristics, which plays an important role in maintaining social stability, preventing and reducing illegal crimes and consolidating state power. However, with the gradual improvement of socialist democracy and rule of law in China, the reform and perfection of reeducation through labor system has become one of the hot issues in the debate. There are still some basic theoretical problems that need to be explored and clarified in the reform of the system of re-education through labor as the direction of the development of the system of education and correction of illegal acts. This paper focuses on the development of the supervision of re-education through labor, the defects of the supervision of re-education through labor, the legal basis and legal principles of the supervision of re-education through labor. The reform, perfection and innovation of the supervision of reeducation through labor are analyzed and discussed. From the point of view of the meaning, function, establishment and development of the supervision of re-education through labor, there are obvious defects in the following aspects: the supervision of re-education through labor is constantly perfect and needs to be improved, the consciousness of supervision, the mechanism of supervision, the supervision of examination and approval, the supervision of execution, and so on. This paper holds that the reform and perfection of the supervision of re-education through labor must be adapted to the diversity of the subject, the specificity of the object, the extensiveness of the content, the standardization of the form and the duality of the function, making clear the science, procedure and coordination. Legal principles of effectiveness, independence, democracy, and responsibility. From the aspects of supervision idea, procuratorial supervision, strengthening function and perfecting internal supervision, the author innovates the current supervision of re-education through labor in China in order to construct a supervision system of reeducation through labor that accords with the requirement of rule of law in our country.
