【摘要】：隨著經(jīng)濟(jì)的增長，市場化進(jìn)程的加快，我國房地產(chǎn)領(lǐng)域賄賂犯罪已經(jīng)成為一種新型高發(fā)的經(jīng)濟(jì)犯罪，嚴(yán)重破壞了市場經(jīng)濟(jì)秩序和市場交易規(guī)則，誘發(fā)了多種犯罪行為。房地產(chǎn)開發(fā)與地方經(jīng)濟(jì)發(fā)展具有雙向效益，這使得房地產(chǎn)開發(fā)項(xiàng)目被許多地方政府一把手當(dāng)成是發(fā)展地方經(jīng)濟(jì)建設(shè)、城市建設(shè)，以及用以宣傳自己執(zhí)政能力的有力手段。隨著房地產(chǎn)市場的發(fā)展，商品房、保障房、經(jīng)濟(jì)適用房等一系列住房保障措施的實(shí)施，城市形象得到改善，城市品位得到提高，使得居民住房消費(fèi)水平也大幅增加，其中也滋生了大量的賄賂犯罪。許多商人和掌權(quán)者借助這一“有利”時(shí)期，無限膨脹自己的私欲，無視國家法律法規(guī)，給予國家工作人員以財(cái)物，收受房地產(chǎn)開發(fā)商給予的賄賂，觸犯國家法律。 本文從房地產(chǎn)領(lǐng)域賄賂犯罪的概述出發(fā)，分析房地產(chǎn)領(lǐng)域賄賂犯罪的典型案例，從現(xiàn)象剖析本質(zhì)，從現(xiàn)狀剖析原因，為發(fā)掘房地產(chǎn)領(lǐng)域賄賂犯罪的效預(yù)防對策進(jìn)行研究。研究房地產(chǎn)領(lǐng)域賄賂犯罪的預(yù)防對策，可以有效控制此領(lǐng)域腐敗問題的滋生，可以對賄賂犯罪的發(fā)生起到一定的克制作用，可以使房地產(chǎn)行業(yè)的發(fā)展朝向規(guī)范化形式轉(zhuǎn)化，并促進(jìn)規(guī)制機(jī)制的建立。 本文分為三個(gè)部分，分別針對房地產(chǎn)領(lǐng)域賄賂犯罪的內(nèi)容進(jìn)行分析寫作。第一部分為我國房地產(chǎn)領(lǐng)域賄賂犯罪的概述，，此部分介紹了我房地產(chǎn)領(lǐng)域賄賂犯罪的概念、現(xiàn)狀及特點(diǎn)。第二部分為我國房地產(chǎn)領(lǐng)域賄賂犯罪的防控現(xiàn)狀及原因分析，此部分介紹了我國房地產(chǎn)領(lǐng)域賄賂犯罪的防控現(xiàn)狀，分析了我國房地產(chǎn)領(lǐng)域賄賂犯罪產(chǎn)生的主觀原因、客觀原因、直接原因和間接原因。第三部分為我國房地產(chǎn)領(lǐng)域賄賂犯罪的預(yù)防對策，此部分通過對以上原因的思考和分析，在立法的完善、司法的完善、法制教育的加強(qiáng)、刑事政策的指導(dǎo)等方面提出了一些相應(yīng)的預(yù)防對策。
[Abstract]:With the growth of economy and the acceleration of market-oriented process, bribery crime in real estate field has become a new type of economic crime, which has seriously damaged the market economic order and market transaction rules, and induced a variety of criminal behaviors. Real estate development and local economic development have two-way benefits, which makes the real estate development project is regarded by many local governments as a powerful means to develop local economic construction, urban construction, and to publicize their own governing ability. With the development of the real estate market, the implementation of a series of housing security measures such as commercial housing, indemnificatory apartment, comfortable housing, and so on, the city image has been improved, and the urban grade has been raised, which has greatly increased the level of housing consumption of residents. It also breeds a large number of bribery crimes. With the help of this "favorable" period, many businessmen and people in power inflated their own selfish desires, ignored the laws and regulations of the state, gave property to state functionaries, accepted bribes from real estate developers, and violated the state law. Starting from the summary of bribery crime in the real estate field, this paper analyzes the typical cases of bribery crime in the real estate field, analyzes the nature of the bribery crime in the real estate field, analyzes the reasons from the current situation, and studies the effective preventive countermeasures for the bribery crime in the real estate field. Studying the preventive measures of bribery crime in real estate can effectively control the breeding of corruption in this field, play a certain role in restraining the occurrence of bribery crime, and make the development of real estate industry turn to the standardized form. And promote the establishment of regulatory mechanism. This paper is divided into three parts, the content of bribery crime in the field of real estate analysis and writing. The first part is an overview of bribery crime in the field of real estate in China. This part introduces the concept, present situation and characteristics of bribery crime in real estate. The second part analyzes the current situation and causes of bribery crime in real estate field of our country. This part introduces the present situation of bribery crime in real estate field of our country, analyzes the subjective reason and objective reason of bribery crime in real estate field of our country. Direct and indirect causes. The third part is the prevention countermeasures of bribery crime in the field of real estate in our country, this part through thinking and analysis to the above reasons, in the legislation consummation, the judicature consummation, the legal system education enhancement, The guidance of criminal policy and other aspects put forward some corresponding preventive countermeasures.
