【摘要】： 近年來,日益嚴(yán)重的女大學(xué)生犯罪現(xiàn)象已經(jīng)引起人們的高度關(guān)注。其中各高校女大學(xué)生的財(cái)產(chǎn)型犯罪的高發(fā)率令人觸目驚心,由此而失足深陷囹圄的花季女大學(xué)生更讓人們扼腕嘆息。因此,對女大學(xué)生為主體的財(cái)產(chǎn)型犯罪動機(jī)進(jìn)行研究,不但可以填補(bǔ)我國目前女大學(xué)生犯罪動機(jī)研究的空白,更能在現(xiàn)實(shí)生活中提醒女大學(xué)生警惕社會不良思潮的侵襲,主動堅(jiān)決地抵御罪惡的引誘,全面提高自身素質(zhì)。同時(shí),深入剖析女大學(xué)生財(cái)產(chǎn)型犯罪動機(jī)也對各高校在預(yù)防女大學(xué)生犯罪的實(shí)踐方面也能起到拋磚引玉的作用。 女大學(xué)生財(cái)產(chǎn)型犯罪是指女大學(xué)生因?yàn)榍址杆素?cái)產(chǎn)權(quán)利而觸犯刑法,具有社會危害性,應(yīng)受刑罰處罰的行為。而財(cái)產(chǎn)型犯罪動機(jī)是激起女大學(xué)生犯罪主觀能動性,直接推動犯罪行為的內(nèi)在心理動力,是促使她們處于實(shí)施犯罪行為的積極狀態(tài)的內(nèi)部原因。而這種犯罪動機(jī)又是由女大學(xué)生的需求、外在誘因以及自身心理調(diào)適機(jī)制等各方面原因相互作用與結(jié)合的結(jié)果。其中,女大學(xué)生的需求和自我意識既是主體做出行為選擇的主要因素,又是積極預(yù)防和矯正女大學(xué)生財(cái)產(chǎn)型犯罪的關(guān)鍵。 本文在對女大學(xué)生的違法犯罪動機(jī)進(jìn)行深入剖析的基礎(chǔ)上,有的放矢地提出防治女大學(xué)生財(cái)產(chǎn)型違法犯罪的措施,即應(yīng)建立一個(gè)社會多方力量參與配合與的防治體系。首先,高校應(yīng)當(dāng)加強(qiáng)針對女生的心理教育,提高其正確對待自身需求的意識,豐富女生文化生活,定期進(jìn)行心理咨詢和測量以便及時(shí)發(fā)現(xiàn)和預(yù)測女生違法犯罪行為;第二,司法機(jī)關(guān)在對失足女大學(xué)生進(jìn)行處罰時(shí),不應(yīng)簡單一罰了之,要全面考量其犯罪主觀方面,針對其特有的犯罪心理采取科學(xué)化的法律制裁手段與人性化的暫緩起訴和刑事污點(diǎn)消滅制度相結(jié)合的方式,既能嚴(yán)厲打擊女大學(xué)生財(cái)產(chǎn)型違法犯罪,又能對其中一部分人給予回爐重鑄般的有效矯治和改造。第三,女大學(xué)生自身更要有意識地提高自身素質(zhì),自覺抵御社會不良習(xí)氣和思想的負(fù)面影響,形成健康成熟的人生觀價(jià)值觀,采用合情合理合法的正確方式來滿足自身需求。
[Abstract]:In recent years, the increasingly serious phenomenon of female college students' crime has attracted people's attention. The high incidence of property-type crime among female college students is alarming, and it is even more deplorable for female college students who are trapped in prison. Therefore, the study on the property motive of female college students can not only fill in the blank of the research on female college students' criminal motivation, but also remind them to be on guard against the invasion of social unhealthy thoughts in real life. Take the initiative and resolutely resist the temptation of evil, improve their overall quality. At the same time, the further analysis of female college students' property-type crime motive can also play an important role in the practice of preventing female college students' crime. The property type crime of female college students refers to the behavior that female college students violate the criminal law because of violating the property rights of others, which has social harmfulness and should be punished by penalty. The motive of property-type crime is the internal psychological power that arouses female college students' subjective initiative of crime and directly promotes the criminal behavior. It is the internal reason that impel them to be in a positive state of criminal behavior. This kind of criminal motive is the result of the interaction and combination of the demand of female college students, external inducement and their own psychological adjustment mechanism. Among them, the demand and self-consciousness of female college students are not only the main factors of the subject's behavior choice, but also the key to actively prevent and correct the female college students' property-type crime. On the basis of deeply analyzing the female college students' motive of breaking the law and committing crimes, this paper puts forward the measures to prevent and cure the property type of crimes committed by female college students, that is, to establish a prevention and control system in which various social forces participate in the cooperation and cooperation. First of all, colleges and universities should strengthen psychological education for female students, improve their awareness of their own needs, enrich their cultural life, and regularly carry out psychological counseling and measurement in order to timely discover and predict the illegal and criminal behavior of female students. Second, when the judiciary punishes female college students who have failed, they should not simply punish them. They should consider the subjective aspects of the crime in a comprehensive way. In view of its unique criminal psychology, the combination of scientific means of legal sanction and humanized suspension of prosecution and elimination of criminal stains can severely crack down on the property crimes of female college students. Also can give some of them to return to the furnace as effective treatment and reconstruction. Third, female college students themselves must consciously improve their own quality, consciously resist the negative impact of social bad habits and thoughts, form a healthy and mature outlook on life values, and adopt a reasonable and legitimate way to meet their own needs.
