【摘要】：DNA鑒定技術(shù)能較為準(zhǔn)確地確定人們之間是否存在血緣關(guān)系 ,因此也就為父母子女身分的確認(rèn)提供了最佳幫助。充分利用DNA鑒定技術(shù) ,在我國將來的親屬立法中明確規(guī)定對于存在父母子女身分關(guān)系之紛爭須采納DNA鑒定技術(shù) ,并建構(gòu)婚生子女的推定、婚生子女的否認(rèn)以及非婚生子女的認(rèn)領(lǐng)制度不僅有外國立法的經(jīng)驗可資借鑒 ,而且是切實保障子女的合法權(quán)益之需要。
[Abstract]:DNA identification technology can accurately determine whether there is a blood relationship between people, so it provides the best help for the identification of parents and children. By making full use of the DNA identification technology, it is clearly stipulated in the future relative legislation of our country that the DNA identification technology should be adopted in the disputes concerning the relationship between parents and children, and the presumption of legitimate children should be constructed. The denial of children born in wedlock and the claim system of children born out of wedlock have not only the experience of foreign legislation, but also the need to protect the legitimate rights and interests of children.
