【摘要】： 隨著我國經(jīng)濟的高速發(fā)展,犯罪問題也如影隨行般日益呈現(xiàn)惡化的趨勢。龐大的犯罪受害人群體中包括了相當數(shù)量的未成年人。以家庭為視角,未成年人犯罪被害總體上可劃分為因家庭內部犯罪行為而受害和因家庭外部犯罪而受害兩種情況。筆者以為,家庭是未成年人保護的第一責任人,未成年人犯罪被害預防應當以父母的有效監(jiān)護為核心,我們可以通過減少家庭侵害行為、加強對父母監(jiān)護職責的督促去盡可能地避免未成年人因犯罪而受害。本論文即試圖通過對父母侵害未成年人和因父母失職導致未成年人受害兩種情形的分析,表明以父母為代表的家庭是未成年人犯罪被害的重要因素,進而提出一些制度性建議以完善以監(jiān)護制度為主體的未成年人家庭保護體系。 文章主體除了導言和結語外,分為四個部分。導言部分簡要地闡述了重視未成年人犯罪被害預防問題的重要性,并表明本文的主旨是以家庭為視角對該問題進行初步的探討。 第一章父母對未成年人的直接侵害主要闡述了父母對未成年人實施家庭暴力和遺棄等侵害的事實以及其中的原因,表明父母對未成年人犯罪侵害構成了未成年人被害的重要侵害源,并為文章在后面的建議部分提出要加強對父母監(jiān)護履行情況的監(jiān)督和強制干預制度提供事實依據(jù)。 第二章家庭保護缺失下的未成年人被害問題主要通過對典型的保護缺失家庭以及處于保護缺失下的易受害未成年人群體的分析,表明家庭保護的缺失是未成年人遭受犯罪侵害的重要因素。 第三章未成年人的被害性及其與父母的關系主要是通過分析未成年人的被害特性證明未成年人犯罪被害預防應主要依靠外界的保護,同時通過分析父母與未成年人被害特性之間的聯(lián)系,表明父母對未成年人被害性的強化負有一定責任,據(jù)此指出父母應當擔負起保護未成年人的主要責任。 第四章完善未成年人家庭保護制度的建議主要是圍繞如何加強對父母監(jiān)護責任履行的監(jiān)督以及如何預防父母侵害未成年人提出監(jiān)護制度的完善、監(jiān)護侵害和失職的發(fā)現(xiàn)機制、公權力的提早干預、監(jiān)護人的強制隔離與矯正、兒童保護專職機構之建立以及加強對父母的教育等建議,以多方面進一步完善我國現(xiàn)有的未成年人家庭保護法律制度。 結語部分對文章進行了總結,提出筆者由于理論水平有限,和資料準備的不足造成本文的觀點可能存在一定的缺陷,并有進一步研究的必要性。
[Abstract]:With the rapid development of economy in China, the problem of crime is worsening day by day. The large group of crime victims includes a considerable number of minors. From the perspective of family, the crime and victimization of minors can be divided into two situations: one is the crime within the family and the other is the crime outside the family. The author thinks that the family is the first person responsible for the protection of minors, and the prevention of juvenile delinquency should be based on the effective custody of parents. Strengthen parental custody duties to avoid juvenile victimization as far as possible. This paper attempts to analyze the two situations of parents' infringing on minors and parents' malfeasance, and shows that the parents' representative families are the important factors of minors' crime and victimization. Then some institutional suggestions are put forward to perfect the family protection system of minors with guardianship system as the main body. In addition to the introduction and conclusion, the main body of the article is divided into four parts. The introduction briefly expounds the importance of paying attention to the prevention of juvenile delinquency and indicates that the purpose of this paper is to make a preliminary discussion on the problem from the perspective of family. In the first chapter, the author expounds the facts and reasons of parental violence and abandonment on minors. It shows that parents' crime against minors constitutes an important source of victimization of minors, and provides a factual basis for strengthening the supervision of parental custody and compulsory intervention system. The second chapter analyzes the problem of minors' victimization under the absence of family protection, mainly through the analysis of typical families with missing protection and vulnerable minors who are in the absence of protection. It shows that the lack of family protection is an important factor for minors to suffer crime. Chapter III: the victimization of minors and their relationship with their parents is mainly through the analysis of the characteristics of minors to prove that the prevention of juvenile delinquency should mainly rely on the protection of the outside world. At the same time, by analyzing the relationship between parents and the characteristics of minors' victimization, it is shown that parents are responsible for the strengthening of minors' victimization, and it is pointed out that parents should shoulder the primary responsibility of protecting minors. The fourth chapter is mainly about how to strengthen the supervision of parental guardianship responsibility and how to prevent parents from infringing minors, and how to improve the guardianship system, the discovery mechanism of guardianship infringement and dereliction of duty. Such suggestions as early intervention of public power, compulsory separation and correction of guardians, establishment of specialized child protection institutions and strengthening of parents' education, will further improve the existing legal system of family protection for minors in China. The conclusion part summarizes the article, and points out that the author may have some defects in the view of this paper because of the limited theoretical level and the shortage of the data preparation, and it is necessary to further study it.
