【摘要】： 在我國(guó),隨著高等教育從精英化向大眾化的逐漸普及和高等教育的跨越式發(fā)展,特別是高校辦學(xué)規(guī)模不斷擴(kuò)大,教育資金投入越來(lái)越多,高校參與經(jīng)濟(jì)活動(dòng)越來(lái)越頻繁,高校與社會(huì)交往越加密切和復(fù)雜,基建規(guī)模和物資采購(gòu)數(shù)量越來(lái)越大,高校已經(jīng)不再是傳統(tǒng)觀念中的象牙塔,高校的管理自主權(quán)不斷加大,一些高校對(duì)上述變化不適應(yīng),思想教育工作缺乏針對(duì)性和有效性,特別是規(guī)章制度和管理措施跟不上,監(jiān)督制約機(jī)制不健全,因此在高校的某些工作領(lǐng)域如教學(xué)物資設(shè)備采購(gòu)、基本建設(shè)、財(cái)務(wù)管理、招生錄取等成為違法違紀(jì)問(wèn)題和職務(wù)犯罪的高發(fā)部位。開展高校職務(wù)犯罪預(yù)防的研究,是保障高校自身組織健康發(fā)展的必然要求,符合中共中央2005年1月17日頒布的《建立健全教育、制度、監(jiān)督并重的懲治和預(yù)防腐敗體系實(shí)施綱要》的總體要求。探討如何構(gòu)筑高校職務(wù)犯罪的預(yù)防體系,為高校黨風(fēng)廉政建設(shè)提供了法律監(jiān)督的新途徑,推動(dòng)了高校預(yù)防職務(wù)犯罪的立法化發(fā)展,有利于高校紀(jì)檢監(jiān)察機(jī)關(guān)預(yù)防職務(wù)犯罪工作的深化開展。 本論文的創(chuàng)新之處在于在法律分析的基礎(chǔ)上,找出高校內(nèi)部管理等方面的不足,力圖構(gòu)建高校職務(wù)犯罪預(yù)防體系,提出當(dāng)前職務(wù)犯罪預(yù)防的對(duì)策和新思路。論文寫作中綜合運(yùn)用文獻(xiàn)研究法和比較研究法等方法,從高校職務(wù)犯罪的發(fā)案率、高發(fā)部位、主體構(gòu)成及主要形式分析了犯罪特點(diǎn),進(jìn)一步深刻剖析誘發(fā)犯罪的因素和根源,主要從高等教育對(duì)市場(chǎng)經(jīng)濟(jì)適應(yīng)程度、高校內(nèi)部管理工作和高校干部思想方面進(jìn)行闡述,并從增強(qiáng)高校管理者法律意識(shí)、完善高等教育立法、構(gòu)建教育制度監(jiān)督并重的懲防體系等方面提出預(yù)防對(duì)策。 高校職務(wù)犯罪預(yù)防是一項(xiàng)系統(tǒng)工程,是高校黨風(fēng)廉政建設(shè)的重要內(nèi)容,需要高校領(lǐng)導(dǎo)干部和廣大群眾共同提高認(rèn)識(shí),參與監(jiān)督,積極預(yù)防,才能收到好的效果。只有這樣,高校職務(wù)犯罪才能得到有效遏制。
[Abstract]:In our country, with the gradual popularization of higher education from elite to popularization and the leap-forward development of higher education, especially the scale of running a university has been expanding, more and more educational funds have been invested, and the participation of colleges and universities in economic activities has become more and more frequent. Colleges and universities have more and more close and complex social contacts, the scale of capital construction and the quantity of material procurement are increasing, the universities are no longer the ivory tower in the traditional concept, the management autonomy of colleges and universities is increasing constantly, some colleges and universities are unable to adapt to the above changes. The ideological education work lacks pertinence and effectiveness, especially the rules and regulations and management measures can not keep up with, the supervision and restriction mechanism is not perfect, so in some areas of work in colleges and universities, such as the procurement of teaching materials and equipment, capital construction, financial management, Enrollment and other issues become illegal and high incidence of job crimes. To carry out research on the prevention of job-related crimes in colleges and universities is an inevitable requirement for ensuring the healthy development of their own organizations, and conforms to the "Establishment and perfection of Education, system" promulgated by the CPC Central Committee on January 17, 2005. Supervision pays equal attention to the overall requirements of the implementation outline of the system of punishment and Prevention of Corruption. This paper probes into how to construct the prevention system of duty crime in colleges and universities, which provides a new way of legal supervision for the construction of party style and clean government in colleges and universities, and promotes the legislative development of the prevention of duty crimes in colleges and universities. This will help the discipline inspection and supervision organs in colleges and universities to deepen their work of preventing job-related crimes. The innovation of this paper lies in finding out the deficiencies of internal management in colleges and universities on the basis of legal analysis, trying to construct the prevention system of duty crime in colleges and universities, and putting forward the countermeasures and new ideas for the prevention of duty crimes at present. In the writing of the thesis, the author analyzes the characteristics of the crime from the angle of the incidence rate, the position of high incidence, the main body and the main form of the crime by using the methods of literature research and comparative research, and further deeply analyzes the factors and root causes of inducing crime. Mainly from the aspects of the adaptation of higher education to the market economy, the internal management of colleges and universities and the ideology of university cadres, and from strengthening the legal consciousness of university administrators and perfecting the legislation of higher education, The prevention countermeasures are put forward in such aspects as constructing the system of punishment and prevention, which pays equal attention to the supervision of education system. The prevention of job-related crimes in colleges and universities is a systematic project and an important part of the construction of a clean and honest party style in colleges and universities. It is necessary for the leading cadres of colleges and universities and the broad masses to jointly raise their understanding, participate in supervision and actively prevent, in order to achieve good results. Only in this way, university duty crime can be effectively contained.
