【摘要】： 警察執(zhí)法的適法性和公正性如何,直接關(guān)系到社會(huì)秩序的穩(wěn)定和公民權(quán)利的實(shí)現(xiàn)。為了保證公民權(quán)利不受到警察權(quán)力的侵犯,警務(wù)活動(dòng)的運(yùn)行必須建立在法治的基礎(chǔ)上,也就是說,必須對(duì)警務(wù)活動(dòng)進(jìn)行有效的監(jiān)督和制約。但現(xiàn)行的警務(wù)監(jiān)督機(jī)制還不夠完備,存在著一些明顯的缺陷與不足。因此,必須完善并整合各個(gè)層面對(duì)警務(wù)活動(dòng)的監(jiān)督制約,使之形成合力,真正防止和解決警察權(quán)力運(yùn)行的失范問題。 本文通過分析當(dāng)前國(guó)內(nèi)警務(wù)監(jiān)督制約機(jī)制的運(yùn)行狀況,并借鑒西方法治國(guó)家規(guī)范警察權(quán)的成功經(jīng)驗(yàn),提出了一套監(jiān)督制約警務(wù)活動(dòng)的方案。即以立法監(jiān)督為前提、司法監(jiān)督為基礎(chǔ)、公安機(jī)關(guān)內(nèi)部監(jiān)督為重點(diǎn)以及權(quán)力制衡(主要是行政權(quán)力與公民權(quán)利的制衡)和社會(huì)監(jiān)督來完成對(duì)警察權(quán)的規(guī)范、制約與監(jiān)督,使各個(gè)層面的監(jiān)督各司其職,互為補(bǔ)充,形成層次分明的監(jiān)督體系。
[Abstract]:The proper and impartial nature of police law enforcement is directly related to the stability of social order and the realization of civil rights. In order to ensure that the civil rights are not infringed by the police power, the operation of the police activities must be based on the rule of law, that is to say, the police activities must be effectively supervised and restricted. However, the current police supervision mechanism is not complete, there are some obvious defects and deficiencies. Therefore, it is necessary to perfect and integrate the supervision and restriction of police activities at all levels so as to form a joint force to prevent and solve the problem of police power abnormalcy. Based on the analysis of the current operation of the police supervision and restriction mechanism in China and the successful experience of the western countries ruled by law in regulating the police power, this paper puts forward a set of schemes for supervising and restricting the policing activities. That is to say, on the basis of legislative supervision, judicial supervision, internal supervision of public security organs, checks and balances of power (mainly checks and balances of administrative power and civil rights) and social supervision to complete the regulation, restriction and supervision of police power. Make each level of supervision perform their respective duties, complement each other, and form a hierarchical supervision system.
