【摘要】： 美國犯罪學和社會學教授薩瑟蘭1939年提出的白領犯罪概念，對西方傳統(tǒng)的局限于社會底層人群的街頭犯罪或者說一般犯罪理論形成了巨大的沖擊。這一概念簡潔而有力的向人們揭示了長期存在但一直模糊不清的白領犯罪問題，清楚的指出犯罪并不僅僅是窮人或者精神異常的人犯下的殺人、搶劫、盜竊等等，衣冠楚楚的社會上層人士憑借其職業(yè)、地位和權勢，運用智能手段的犯下的罪行更為嚴重，同時更加具有隱蔽性和對刑法的規(guī)避性，難以得到有效的懲治。半個多世紀過去了，西方白領犯罪的研究雖然仍無法像薩瑟蘭教授所倡導的那樣占據(jù)犯罪學研究的主流地位，但是已經(jīng)得到了長足的發(fā)展，走過了從白領犯罪到職業(yè)犯罪再到公司或組織犯罪的研究之路，建立形成了相對完整的理論體系�，F(xiàn)在，白領犯罪業(yè)已成為社會學、犯罪學和刑法學的一個專業(yè)術語。特別自美國安然公司丑聞以后，白領犯罪理論在指導預防和懲治白領犯罪實踐方面的重要性不斷凸顯。相比之下，我國犯罪學和刑法學對白領犯罪缺乏應有的關注，相關理論研究和著述甚少，沒有建立起關于白領犯罪的比較完善的理論體系。原因是多方面的，既有意識形態(tài)方面的顧慮，又有大眾認知的落后。然而，理論研究應當具有前瞻性，我們不能忽視伴隨著我國改革開放和市場經(jīng)濟跨越式發(fā)展而大量出現(xiàn)的白領犯罪現(xiàn)象，如花樣百出的金融詐騙、屢禁不止的貪污賄賂、損失驚人的環(huán)境污染等等，必須對此保持高度的警惕性，及時分析成因，提出預防和控制對策，抑制住白領犯罪井噴式爆發(fā)和對經(jīng)濟發(fā)展的破壞性影響。 本文共分為三章。第一章介紹白領犯罪的概念和特征。通過對西方白領概念的研究得出白領內涵中國化的三個階段，明確在中國可以歸入白領階層范圍的人群，劃定研究的界限。重點論述了薩瑟蘭的白領犯罪原始概念，并在此基礎上結合時代背景對西方白領犯罪概念研究發(fā)展的歷史脈絡進行了梳理，指出職業(yè)犯罪和公司犯罪是當代西方白領犯罪研究的兩大支柱。對我國現(xiàn)階段的白領犯罪概念研究進行了初步歸納，并在此基礎上探討提出了自己對白領犯罪概念的定義。為更加直觀、精確的把握白領犯罪概念，從不同角度對白領犯罪的重要特征進行了闡述。 第二章分析了白領犯罪的現(xiàn)狀和成因。對我國現(xiàn)階段的白領職業(yè)犯罪、計算機犯罪和公司組織犯罪的現(xiàn)狀進行了初步分析，通過案例分析和實證資料相結合的方法，指出了我國現(xiàn)階段白領犯罪的嚴峻形勢和嚴重的社會危害性。進而深入探尋造成白領犯罪的成因，重點介紹了差異交往理論、社會反常理論、亞文化理論、批判犯罪理論、一般性犯罪理論等西方關于白領犯罪的成因理論，，并借鑒其研究成果，根據(jù)我國現(xiàn)階段情況從社會層面、個人層面、法律層面上對白領犯罪成因進行了剖析。 第三章提出了對白領犯罪的預防和控制對策。鑒于白領犯罪是極其復雜的社會現(xiàn)象，單一的預防和控制措施難以奏效，因而筆者嘗試從社會基礎調控、個人因素控制、立法司法網(wǎng)絡等方面提出了綜合的預防和控制措施。社會基礎調控方面強調了政府、市場和公司的作用，個人因素控制方面突出了道德教化、白領犯罪教育、制度控制的作用，立法司法網(wǎng)絡的構建要求既要有法可依，也要執(zhí)法必嚴�？偟膩碚f，白領犯罪的預防和控制對策宏觀上要緊跟政府發(fā)展經(jīng)濟的步伐，要有基本理論支撐，微觀上要注意逐步改進具體制度的科學性和合理性，要執(zhí)行得力，落實到位。
