【摘要】： 美國犯罪學(xué)和社會(huì)學(xué)教授薩瑟蘭1939年提出的白領(lǐng)犯罪概念，對(duì)西方傳統(tǒng)的局限于社會(huì)底層人群的街頭犯罪或者說一般犯罪理論形成了巨大的沖擊。這一概念簡(jiǎn)潔而有力的向人們揭示了長期存在但一直模糊不清的白領(lǐng)犯罪問題，清楚的指出犯罪并不僅僅是窮人或者精神異常的人犯下的殺人、搶劫、盜竊等等，衣冠楚楚的社會(huì)上層人士憑借其職業(yè)、地位和權(quán)勢(shì)，運(yùn)用智能手段的犯下的罪行更為嚴(yán)重，同時(shí)更加具有隱蔽性和對(duì)刑法的規(guī)避性，難以得到有效的懲治。半個(gè)多世紀(jì)過去了，西方白領(lǐng)犯罪的研究雖然仍無法像薩瑟蘭教授所倡導(dǎo)的那樣占據(jù)犯罪學(xué)研究的主流地位，但是已經(jīng)得到了長足的發(fā)展，走過了從白領(lǐng)犯罪到職業(yè)犯罪再到公司或組織犯罪的研究之路，建立形成了相對(duì)完整的理論體系�，F(xiàn)在，白領(lǐng)犯罪業(yè)已成為社會(huì)學(xué)、犯罪學(xué)和刑法學(xué)的一個(gè)專業(yè)術(shù)語。特別自美國安然公司丑聞以后，白領(lǐng)犯罪理論在指導(dǎo)預(yù)防和懲治白領(lǐng)犯罪實(shí)踐方面的重要性不斷凸顯。相比之下，我國犯罪學(xué)和刑法學(xué)對(duì)白領(lǐng)犯罪缺乏應(yīng)有的關(guān)注，相關(guān)理論研究和著述甚少，沒有建立起關(guān)于白領(lǐng)犯罪的比較完善的理論體系。原因是多方面的，既有意識(shí)形態(tài)方面的顧慮，又有大眾認(rèn)知的落后。然而，理論研究應(yīng)當(dāng)具有前瞻性，我們不能忽視伴隨著我國改革開放和市場(chǎng)經(jīng)濟(jì)跨越式發(fā)展而大量出現(xiàn)的白領(lǐng)犯罪現(xiàn)象，如花樣百出的金融詐騙、屢禁不止的貪污賄賂、損失驚人的環(huán)境污染等等，必須對(duì)此保持高度的警惕性，及時(shí)分析成因，提出預(yù)防和控制對(duì)策，抑制住白領(lǐng)犯罪井噴式爆發(fā)和對(duì)經(jīng)濟(jì)發(fā)展的破壞性影響。 本文共分為三章。第一章介紹白領(lǐng)犯罪的概念和特征。通過對(duì)西方白領(lǐng)概念的研究得出白領(lǐng)內(nèi)涵中國化的三個(gè)階段，明確在中國可以歸入白領(lǐng)階層范圍的人群，劃定研究的界限。重點(diǎn)論述了薩瑟蘭的白領(lǐng)犯罪原始概念，并在此基礎(chǔ)上結(jié)合時(shí)代背景對(duì)西方白領(lǐng)犯罪概念研究發(fā)展的歷史脈絡(luò)進(jìn)行了梳理，指出職業(yè)犯罪和公司犯罪是當(dāng)代西方白領(lǐng)犯罪研究的兩大支柱。對(duì)我國現(xiàn)階段的白領(lǐng)犯罪概念研究進(jìn)行了初步歸納，并在此基礎(chǔ)上探討提出了自己對(duì)白領(lǐng)犯罪概念的定義。為更加直觀、精確的把握白領(lǐng)犯罪概念，從不同角度對(duì)白領(lǐng)犯罪的重要特征進(jìn)行了闡述。 第二章分析了白領(lǐng)犯罪的現(xiàn)狀和成因。對(duì)我國現(xiàn)階段的白領(lǐng)職業(yè)犯罪、計(jì)算機(jī)犯罪和公司組織犯罪的現(xiàn)狀進(jìn)行了初步分析，通過案例分析和實(shí)證資料相結(jié)合的方法，指出了我國現(xiàn)階段白領(lǐng)犯罪的嚴(yán)峻形勢(shì)和嚴(yán)重的社會(huì)危害性。進(jìn)而深入探尋造成白領(lǐng)犯罪的成因，重點(diǎn)介紹了差異交往理論、社會(huì)反常理論、亞文化理論、批判犯罪理論、一般性犯罪理論等西方關(guān)于白領(lǐng)犯罪的成因理論，，并借鑒其研究成果，根據(jù)我國現(xiàn)階段情況從社會(huì)層面、個(gè)人層面、法律層面上對(duì)白領(lǐng)犯罪成因進(jìn)行了剖析。 第三章提出了對(duì)白領(lǐng)犯罪的預(yù)防和控制對(duì)策。鑒于白領(lǐng)犯罪是極其復(fù)雜的社會(huì)現(xiàn)象，單一的預(yù)防和控制措施難以奏效，因而筆者嘗試從社會(huì)基礎(chǔ)調(diào)控、個(gè)人因素控制、立法司法網(wǎng)絡(luò)等方面提出了綜合的預(yù)防和控制措施。社會(huì)基礎(chǔ)調(diào)控方面強(qiáng)調(diào)了政府、市場(chǎng)和公司的作用，個(gè)人因素控制方面突出了道德教化、白領(lǐng)犯罪教育、制度控制的作用，立法司法網(wǎng)絡(luò)的構(gòu)建要求既要有法可依，也要執(zhí)法必嚴(yán)�？偟膩碚f，白領(lǐng)犯罪的預(yù)防和控制對(duì)策宏觀上要緊跟政府發(fā)展經(jīng)濟(jì)的步伐，要有基本理論支撐，微觀上要注意逐步改進(jìn)具體制度的科學(xué)性和合理性，要執(zhí)行得力，落實(shí)到位。
