【摘要】： 我國(guó)公安機(jī)關(guān)作為人民民主專政的重要工具,在擔(dān)負(fù)著鞏固共產(chǎn)黨執(zhí)政地位、維護(hù)社會(huì)安定團(tuán)結(jié)、保障人民群眾安居樂(lè)業(yè)的重要?dú)v史使命的同時(shí),被賦予了廣泛的行政執(zhí)法權(quán)和刑事司法權(quán)。公安機(jī)關(guān)掌握的這些權(quán)力猶如一柄“雙刃劍”,既可以用來(lái)保障人權(quán)、鞏固政權(quán),同時(shí)也可以因?yàn)闉E用權(quán)力而侵犯人權(quán)、影響國(guó)家政權(quán)的正常運(yùn)行。在新的歷史形勢(shì)下,一方面,建設(shè)社會(huì)主義和諧社會(huì)、保障人權(quán)需要對(duì)我國(guó)公安機(jī)關(guān)及其人民警察的角色重新進(jìn)行定位:另一方面,臺(tái)獨(dú)勢(shì)力、西藏分裂勢(shì)力的猖獗及國(guó)際挑釁,又需要我國(guó)公安機(jī)關(guān)及其人民警察在一定程度上保持其原有的專政與暴力性質(zhì)。這種形勢(shì)下,如何更加科學(xué)有效地監(jiān)督公安機(jī)關(guān)及其人民警察、規(guī)范其執(zhí)法權(quán)力的行使成為擺在我國(guó)執(zhí)政黨和政府面前的一個(gè)重要課題,因此,研究如何進(jìn)一步加強(qiáng)和完善公安內(nèi)部執(zhí)法監(jiān)督制度也就顯得尤為重要。 本文第一部分對(duì)公安內(nèi)部執(zhí)法監(jiān)督制度的一般原理、發(fā)展歷程及國(guó)外、我國(guó)香港地區(qū)的相關(guān)規(guī)定和做法進(jìn)行了系統(tǒng)闡述,第二部分詳細(xì)分析了我國(guó)公安內(nèi)部執(zhí)法監(jiān)督制度的現(xiàn)狀,在對(duì)當(dāng)前我國(guó)公安內(nèi)部執(zhí)法監(jiān)督工作取得成績(jī)進(jìn)行肯定的同時(shí),結(jié)合真實(shí)案例,深入分析和闡述了當(dāng)前我國(guó)公安內(nèi)部執(zhí)法監(jiān)督制度存在的主要問(wèn)題及其成因。第三部分根據(jù)第二部分對(duì)我國(guó)公安內(nèi)部執(zhí)法監(jiān)督現(xiàn)狀的分析,重點(diǎn)從以下五個(gè)方面提出了相應(yīng)的完善對(duì)策:一是從思想認(rèn)識(shí)的角度,探討了如何創(chuàng)新理念,提高素質(zhì),增強(qiáng)接受監(jiān)督的主動(dòng)性和積極性等問(wèn)題;二是從完善立法、健全監(jiān)督制度的角度,建議在公安內(nèi)部執(zhí)法監(jiān)督制度中要統(tǒng)一立法,以解決目前存在的監(jiān)督依據(jù)混亂問(wèn)題;三是針對(duì)當(dāng)前公安內(nèi)部執(zhí)法監(jiān)督工作體制不順、分工不明問(wèn)題,重點(diǎn)就如何統(tǒng)一協(xié)調(diào)及解決各監(jiān)督部門(mén)間的工作分工問(wèn)題提出了具體的完善對(duì)策;四是從科學(xué)監(jiān)督的角度,探討了監(jiān)督方式、監(jiān)督手段、監(jiān)督理念的科學(xué)性問(wèn)題:五是從內(nèi)外結(jié)合的角度,分析并論證了公安內(nèi)部執(zhí)法監(jiān)督與公民監(jiān)督和新聞媒體監(jiān)督相結(jié)合的必要性。
[Abstract]:As an important tool of the people's democratic dictatorship, our public security organs shoulder the important historical mission of consolidating the ruling position of the Communist Party, maintaining social stability and unity, and ensuring the people to live and work in peace and contentment. Has been given a wide range of administrative law enforcement and criminal justice power. These powers held by public security organs are like a "double-edged sword", which can be used to protect human rights and consolidate political power, but also to violate human rights because of abuse of power and to affect the normal operation of state power. Under the new historical situation, on the one hand, the construction of a harmonious socialist society and the protection of human rights need to reposition the role of our public security organs and their people's police: on the other hand, the forces of Taiwan independence, The rampant secessionist forces in Tibet and international provocations also require our public security organs and their people's police to maintain their original dictatorship and violent nature to a certain extent. Under this situation, how to supervise the public security organs and the people's police more scientifically and effectively and standardize the exercise of their law enforcement power has become an important subject in front of the ruling party and the government of our country. It is particularly important to study how to further strengthen and perfect the internal law enforcement supervision system of public security. In the first part of this paper, the general principle, development course and relevant regulations and practices of public security internal law enforcement and supervision system are systematically expounded. The second part analyzes the current situation of the internal law enforcement supervision system in our country in detail, while affirming the achievements of the internal law enforcement supervision work in our country, combined with the real cases. This paper deeply analyzes and expounds the main problems and causes of the internal law enforcement supervision system in our country. The third part, according to the second part of the analysis of the current situation of our country's internal law enforcement supervision of public security, put forward the corresponding improvement countermeasures from the following five aspects: first, from the perspective of ideological understanding, discussed how to innovate the concept, improve the quality, Strengthening the initiative and enthusiasm of accepting supervision; Second, from the angle of perfecting the legislation and perfecting the supervision system, it is suggested to unify the legislation in the internal law enforcement supervision system of the public security in order to solve the existing problems of the confusion of the supervision basis; Thirdly, aiming at the problem that the internal law enforcement supervision system of public security is not smooth and the division of labor is not clear, this paper puts forward some concrete and perfect countermeasures on how to unify and coordinate and solve the division of work among the supervision departments. Fourth, from the point of view of scientific supervision, it discusses the scientific problems of supervision methods, means and concepts of supervision: fifth, from the angle of combination of internal and external, This paper analyzes and demonstrates the necessity of the combination of internal law enforcement supervision with citizen supervision and news media supervision.
