【摘要】： 未成年人違法犯罪是一種復(fù)雜的社會(huì)現(xiàn)象,它不僅嚴(yán)重危害了社會(huì)秩序,擾亂了經(jīng)濟(jì)建設(shè)與社會(huì)發(fā)展,也嚴(yán)重影響到未成年人的健康成長(zhǎng)。未成年人違法犯罪包括違反《刑法》與《治安管理處罰法》的行為,也包括未成年人的不良行為與嚴(yán)重不良行為�？偟恼f(shuō)來(lái),未成年人違法犯罪是其社會(huì)化過(guò)程中出現(xiàn)的缺陷與不足所致。目前我國(guó)正處在社會(huì)轉(zhuǎn)型期,經(jīng)濟(jì)的發(fā)展和城市化進(jìn)程的加快,使得社區(qū)的地位不斷提升,社區(qū)越來(lái)越成為影響未成年人違法犯罪的重要因素。因而探求切實(shí)有效的社區(qū)防范對(duì)策已成為社會(huì)的當(dāng)務(wù)之急。 本文以國(guó)外學(xué)者提出的未成年人違法犯罪的理論模式為基礎(chǔ),以國(guó)內(nèi)外社區(qū)預(yù)防未成年人違法犯罪方面取得的成功經(jīng)驗(yàn)為依托,走訪武漢、南昌兩地多個(gè)社區(qū),對(duì)數(shù)十人進(jìn)行有針對(duì)性的訪談,實(shí)證性地考察了社區(qū)對(duì)易犯罪未成年人違法犯罪的影響,并分析了社區(qū)可能對(duì)易犯罪未成年人違法犯罪的不良影響,以及當(dāng)前國(guó)內(nèi)社區(qū)工作方面存在的諸多問(wèn)題,進(jìn)而提出易犯罪未成年人違法犯罪的社區(qū)防范對(duì)策。 本文按內(nèi)容分為四個(gè)部分。第一部分是引言,主要介紹了當(dāng)前國(guó)內(nèi)未成年人違法犯罪現(xiàn)狀,研究目的及意義。第二部分是文獻(xiàn)綜述與問(wèn)題的提出,主要介紹了國(guó)內(nèi)外研究現(xiàn)狀及相關(guān)概念說(shuō)明,為下文的論述奠定了基礎(chǔ)。第三部分是實(shí)證調(diào)查研究部分,主要以社區(qū)中的工作人員,教師,家長(zhǎng)及未成年人為研究對(duì)象,運(yùn)用訪談的形式實(shí)證性地考察了社區(qū)對(duì)易犯罪未成年人違法犯罪的影響,主要包括社區(qū)環(huán)境,社區(qū)中的家庭,社區(qū)中的學(xué)校。第四部分是對(duì)策探討部分,在第二、三部分的基礎(chǔ)上提出易犯罪未成年人違法犯罪的社區(qū)防范對(duì)策,認(rèn)為易犯罪未成年人違法犯罪的社區(qū)有效預(yù)防應(yīng)當(dāng)從優(yōu)化社區(qū)人文環(huán)境,注重情境預(yù)防、加強(qiáng)社工隊(duì)伍建設(shè)、提高對(duì)未成年人違法犯罪的認(rèn)識(shí)以及構(gòu)建社區(qū)、學(xué)校、家庭三位一體的互動(dòng)機(jī)制等四個(gè)方面來(lái)著手。
[Abstract]:Juvenile delinquency is a complex social phenomenon, which not only seriously endangers the social order, disturbs the economic construction and social development, but also seriously affects the healthy growth of minors. Juvenile delinquency includes violation of Criminal Law and Public Security Administration punishment Law, but also includes minor's bad behavior and serious bad behavior. Generally speaking, juvenile delinquency is the result of defects and deficiencies in the process of socialization. At present, our country is in the social transition period, the development of economy and the acceleration of urbanization process, make the status of the community constantly improve, the community has become more and more important factors affecting juvenile delinquency. Therefore, to explore effective community preventive measures has become the top priority of the society. Based on the theoretical model of juvenile delinquency proposed by foreign scholars, and based on the successful experience gained in preventing juvenile delinquency in the community at home and abroad, this paper visits many communities in Wuhan and Nanchang. Through targeted interviews with dozens of people, the paper empirically examines the impact of the community on delinquency among vulnerable minors, and analyzes the possible adverse effects of the community on delinquency among vulnerable minors. As well as the problems existing in the current community work in China, and then put forward the community prevention countermeasures of delinquency and juvenile delinquency. This paper is divided into four parts according to the content. The first part is the introduction, mainly introduces the current situation of juvenile delinquency in China, the purpose and significance of the research. The second part is the literature review and the question put forward, mainly introduced the domestic and foreign research present situation and the related concept note, has laid the foundation for the following discussion. The third part is the empirical research part, mainly taking the community staff, teachers, parents and minors as the research object, using the form of interviews to investigate the impact of the community on delinquency and delinquency of delinquency minors. Mainly include community environment, community families, community schools. The fourth part is the countermeasure discussion part. On the basis of the second and the third part, the author puts forward the community preventive countermeasures of delinquency and juvenile delinquency, and thinks that the community effective prevention of delinquency should be based on optimizing the humanistic environment of the community. Pay attention to situational prevention, strengthen the construction of social work team, improve the understanding of juvenile delinquency and construct the interaction mechanism of community, school and family.
