試論新時期基層公安機關(guān)執(zhí)法監(jiān)督機制

【摘要】：公安機關(guān)作為具有武裝性質(zhì)的國家刑事司法力量和行政執(zhí)法力量,長期以來擔(dān)負(fù)著維護(hù)國家長治久安、服務(wù)經(jīng)濟社會發(fā)展、保障人民安居樂業(yè)的重大政治和社會責(zé)任。使命的光榮性、任務(wù)的艱巨性、權(quán)力的集中性于一身。公安機關(guān)及其人民警察行使職權(quán)的效率和廉潔性不僅僅關(guān)系到每位公民的切身利益,還直接關(guān)系到黨和國家、政府的形象,關(guān)系到依法治國的成效和社會主義法治國家目標(biāo)的實現(xiàn)。特別是當(dāng)前隨著社會經(jīng)濟的發(fā)展、人民法制意識的不斷提高,國家正處于一個重要的社會轉(zhuǎn)型期,各階層利益面臨著大調(diào)整,各種社會矛盾積聚,這些都使得我們公安機關(guān)人民警察的執(zhí)法環(huán)境發(fā)生了巨大變化。面對著凸顯的人民內(nèi)部矛盾、高發(fā)的刑事案件,承擔(dān)著維護(hù)社會秩序、保持治安穩(wěn)定的公安機關(guān)及其民警自然就處于社會矛盾的風(fēng)口浪尖之上。面臨如此復(fù)雜的社會形勢和執(zhí)法環(huán)境,如何能夠更加科學(xué)有效地規(guī)范公安機關(guān)的執(zhí)法行為、監(jiān)督公安民警的職責(zé)履行,使之真正成為完善的監(jiān)督制約機制并形成常態(tài)堅持運行就成為擺在我們黨和政府面前的一項重要課題。本文筆者從一名基層公安機關(guān)紀(jì)檢監(jiān)察民警的工作視角出發(fā),結(jié)合公安執(zhí)法工作的實際,就如何進(jìn)一步健全公安執(zhí)法監(jiān)督工作運行機制做一番粗淺的探討,并試圖對公安執(zhí)法監(jiān)督制度的改革與完善提出可能的建議。本文第一部分對公安執(zhí)法監(jiān)督制度的基本原理即概念、特征以及加強公安執(zhí)法監(jiān)督工作的必要性進(jìn)行了詳細(xì)的闡述。第二部分通過梳理比對公安機關(guān)現(xiàn)有監(jiān)督機構(gòu)各自職能,特別是對照國外、及我國香港地區(qū)的相關(guān)做法深入分析了當(dāng)前我國執(zhí)法監(jiān)督制度存在的主要問題和影響執(zhí)法監(jiān)督執(zhí)法發(fā)展的制約因素,最后一部分針對文章前半部分分析比對出問題,依托基層公安工作實踐,就進(jìn)一步加強公安執(zhí)法監(jiān)督工作改革提出合理化的建議措施。
[Abstract]:As a national criminal judicial force and administrative law enforcement force with armed nature, public security organs have long shouldered the great political and social responsibility of maintaining the long-term stability of the country, serving the economic and social development, and ensuring the people to live and work in peace and contentment. The glory of the mission, the arduous nature of the task, the centralization of power. The efficiency and integrity of the public security organs and their people's police in exercising their functions and powers are not only related to the vital interests of every citizen, but also directly related to the image of the party, the state and the government. Related to the effectiveness of the rule of law and the realization of the goal of the socialist country ruled by law. In particular, with the development of the social economy and the continuous improvement of the people's awareness of the legal system, the country is in an important social transition period, the interests of all strata are facing great adjustment, and various kinds of social contradictions are accumulating. These make our public security organs people's police law enforcement environment has undergone tremendous changes. In the face of the prominent contradictions among the people and the high incidence of criminal cases, the public security organs and their police, which are responsible for maintaining social order and maintaining public order and stability, are naturally on top of the social contradictions. Faced with such a complex social situation and law enforcement environment, how can we more scientifically and effectively regulate the law enforcement actions of public security organs and supervise the performance of the duties of the public security police? It is an important task for our Party and government to make it a perfect supervision and restriction mechanism and to persist in its normal operation. From the perspective of the discipline inspection and supervision of a grass-roots public security organ and the reality of public security law enforcement, the author makes a brief discussion on how to further improve the operational mechanism of public security law enforcement supervision. It also tries to put forward some possible suggestions on the reform and perfection of public security law enforcement supervision system. In the first part of this paper, the basic principle of the public security law enforcement supervision system is described in detail, including the concept, characteristics and the necessity of strengthening the public security law enforcement supervision work. In the second part, by combing and comparing the respective functions of the existing supervisory organs of public security organs, especially in comparison with foreign countries, And the relevant practices in Hong Kong area of our country have deeply analyzed the main problems existing in the current law enforcement supervision system of our country and the restrictive factors affecting the law enforcement supervision and law enforcement development. The last part has analyzed and compared the problems in the first half of the article. Based on the practice of public security work at the grass-roots level, this paper puts forward some reasonable measures to strengthen the reform of law enforcement supervision of public security.
