淺析女性犯罪人由被害到犯罪的“惡逆變”

【摘要】：女性犯罪中 ,有相當(dāng)一部分犯罪人具有從被害人到犯罪人轉(zhuǎn)變的過(guò)程 ,即女性犯罪的“惡逆變”。女性犯罪“惡逆變”在暴力犯罪和性犯罪中比較突出 ,所侵害的對(duì)象具有特定性。女性犯罪“惡逆變”的發(fā)生是一個(gè)犯罪動(dòng)機(jī)形成的過(guò)程 ,其直接動(dòng)因是 :消極的不良情緒的長(zhǎng)期積累 ,為泄憤導(dǎo)致“惡逆變” ;急于擺脫當(dāng)前不幸處境 ,以惡抗惡 ,導(dǎo)致“惡逆變”的發(fā)生 ;對(duì)人生的絕望 ,導(dǎo)致“惡逆變”。女性犯罪“惡逆變”與犯罪主體的消極心理密切相關(guān)。要預(yù)防女性犯罪“惡逆變” ,須加強(qiáng)社會(huì)主義精神文明建設(shè) ,創(chuàng)造良好的家庭氛圍和社區(qū)環(huán)境 ;加強(qiáng)基層組織建設(shè) ,充分發(fā)揮其預(yù)防犯罪的作用 ;各級(jí)司法部門要及時(shí)、嚴(yán)厲打擊家庭暴力犯罪 ,運(yùn)用法律手段預(yù)防女性犯罪 ;家庭成員之間應(yīng)建立起平等和睦的關(guān)系 ,營(yíng)造良好的家庭氛圍 ;女性要注意提高自身素質(zhì) ,自強(qiáng)自立。
[Abstract]:In female crime, a considerable number of offenders have the process of changing from victim to criminal, that is, female crime. Female crime is more prominent in violent crime and sexual crime, and the target is specific. The occurrence of female crime "evil inversion" is a process of criminal motive formation, its direct motive is: the long-term accumulation of negative bad emotion, causes "evil inversion" in order to express indignation; Eager to get rid of the current unfortunate situation, to resist evil, leading to the occurrence of "evil inversion", despair of life, leading to "evil reverse change." Female crime is closely related to the negative psychology of the subject of crime. In order to prevent female crime from becoming evil, we must strengthen the construction of socialist spiritual civilization, create a good family atmosphere and community environment, strengthen the construction of grass-roots organizations and give full play to their role in crime prevention. The judicial departments at all levels should promptly and severely crack down on crimes of domestic violence and use legal means to prevent crimes committed by women, and establish equal and harmonious relations among family members to create a good family atmosphere; Women should pay attention to improving their own quality, self-reliance.
