【摘要】： 本文從社會學(xué)意義上的社會四要素出發(fā)，界定了黑社會應(yīng)包含的基本內(nèi)涵，并從行為組織學(xué)的視角論述了黑社會組織形成的必然性，在此基礎(chǔ)上對黑社會組織及黑社會犯罪的概念進(jìn)行界定，并剖析了黑社會組織與犯罪集團、有組織犯罪、恐怖組織等各自的法律概念、特征及相互之間的區(qū)別，指出了我國官方當(dāng)前對黑社會性質(zhì)組織概念特征界定的不足，支持了黑社會性質(zhì)組織本質(zhì)上就是處于發(fā)展的初級階段的黑社會組織觀點并提出了自己的觀點。筆者結(jié)合當(dāng)前我國黑社會組織的現(xiàn)狀、特點及發(fā)展趨勢，對我國黑社會組織產(chǎn)生的社會、政治、經(jīng)濟、文化、國際環(huán)境以及黑社會組織成員主體原因進(jìn)行了全面地、深入淺出的分析，指出黑社會犯罪的發(fā)生發(fā)展是個自發(fā)的運動，是社會內(nèi)部矛盾和環(huán)境條件交叉作用的結(jié)果，是以社會不平等、社會對金錢的追求、犯罪亞文化等社會內(nèi)部矛盾為根據(jù)的。其中，社會不平等是黑社會組織犯罪的社會根源，社會對金錢的追求是黑社會組織犯罪的驅(qū)動力，犯罪亞文化是黑社會組織犯罪的精神支柱。而政治腐敗是黑社會組織犯罪孳生和發(fā)展壯大的溫床，社會控制弱化是黑社會組織犯罪孳長的環(huán)境和條件，境外黑社會組織的滲透則是黑社會組織犯罪發(fā)生的環(huán)境條件，論證了處于社會轉(zhuǎn)型期的我國產(chǎn)生黑社會組織的必然性以及必將面臨的更加嚴(yán)峻的同黑社會組織犯罪作斗爭的形勢。在此基礎(chǔ)上，針對我國當(dāng)前“打黑”法律及實踐中的不足，提出了進(jìn)一步嚴(yán)密法網(wǎng)完善“打黑”法律體系、多策并舉實現(xiàn)打防控一體等當(dāng)前形勢下防范打擊黑社會犯罪的應(yīng)對措施。可以說，本文既有一定的理論深度，也具有一定的實踐指導(dǎo)意義。
[Abstract]:Starting from the four elements of the society in the sociological sense, this paper defines the basic connotation that the underworld should contain, and discusses the inevitability of the formation of the underworld organization from the perspective of behavioral organization. On this basis, the concept of underworld organization and underworld crime is defined, and the legal concepts, characteristics and differences between underworld organization and criminal group, organized crime and terrorist organization are analyzed. This paper points out the insufficiency of the definition of the concept of the underworld nature organization in our country at present, supports the underworld organization viewpoint which is essentially in the primary stage of development, and puts forward its own viewpoint. Combined with the present situation, characteristics and development trend of the underworld organizations in our country, the author makes a comprehensive analysis of the social, political, economic, cultural, international environment and the main causes of the members of the underworld organizations in our country. The author points out that the occurrence and development of underworld crime is a spontaneous movement, the result of the intersecting effects of social internal contradictions and environmental conditions, and the pursuit of money by society because of social inequality. Criminal subculture and other social contradictions are based on. Among them, the social inequality is the social root of the underworld organization crime, the social pursuit of money is the driving force of the underworld organization crime, and the criminal subculture is the spiritual pillar of the underworld organization crime. The political corruption is the breeding ground for the growth and development of the underworld organization crime, the weakening of social control is the environment and condition for the growth of the underworld organization crime, and the infiltration of the overseas underworld organization is the environmental condition for the occurrence of the underworld organization crime. This paper demonstrates the inevitability of the emergence of underworld organizations in China during the period of social transformation and the more severe situation of fighting against the crime of underworld organizations. On this basis, in view of the deficiency in the current law and practice of "fighting against black" in our country, the author puts forward that the legal system of "fighting against black" should be further improved by strict legal net. Many measures should be taken to prevent and control the underworld crime in the current situation. It can be said that this paper not only has certain theoretical depth, but also has certain practical significance.
