【摘要】：現(xiàn)代社會(huì),未成年人犯罪問(wèn)題已經(jīng)成為全球性的難題。根據(jù)有關(guān)數(shù)據(jù)顯示,近年來(lái)我國(guó)未成年人犯罪人數(shù)呈現(xiàn)出逐年上升趨勢(shì)。如何在堅(jiān)持教育為主、懲罰為輔的原則的基礎(chǔ)上,充分調(diào)動(dòng)社會(huì)的積極因素,謀求最為有效的方法來(lái)預(yù)防和減少未成年人犯罪,已經(jīng)成為少年刑事司法活動(dòng)的當(dāng)務(wù)之急。犯罪原因的多元性、多層次性以及未成年人自身的特殊性決定了必須對(duì)未成年人違法犯罪采取更為科學(xué)和人性化的矯正方式,而社區(qū)矯正是當(dāng)今世界各國(guó)普遍采用的一種被證明行之有效的矯正方式。將未成年犯罪人置于社區(qū)之中進(jìn)行矯正,并在社區(qū)矯正的環(huán)境中對(duì)他們進(jìn)行思想政治教育已經(jīng)越來(lái)越成為未成年犯罪人矯正教育的趨勢(shì)。 本文將社區(qū)矯正中的未成年人思想政治教育定義為:對(duì)于罪行較輕、在社區(qū)進(jìn)行矯正的未成年犯罪人,整合社會(huì)、家庭、學(xué)校等各方面教育資源,對(duì)其犯罪心理和不良行為進(jìn)行矯正、并對(duì)其成長(zhǎng)給予幫助的教育活動(dòng)。其特點(diǎn)表現(xiàn)為前提是在社區(qū)矯正的環(huán)境之中、對(duì)象是罪行較輕的未成年犯罪人、性質(zhì)是刑罰執(zhí)行體系的一部分三個(gè)方面。隨后介紹了我國(guó)社區(qū)矯正試點(diǎn)地區(qū)的未成年犯罪人思想政治教育的現(xiàn)狀,總結(jié)了取得的成功經(jīng)驗(yàn)和有益做法,指出了存在的問(wèn)題和存在這些問(wèn)題的原因,繼而分析借鑒了先進(jìn)國(guó)家的經(jīng)驗(yàn)和做法。就我國(guó)社區(qū)矯正中的未成年人思想政治教育的現(xiàn)實(shí)選擇提出了自己的構(gòu)想:在指導(dǎo)思想方面提出以科學(xué)發(fā)展觀為指導(dǎo)、在指導(dǎo)原則方面提出教育與懲罰相結(jié)合、專門(mén)部門(mén)與社會(huì)資源相配合、學(xué)校教育與家庭教育相協(xié)調(diào)、思想教育與技能教育相統(tǒng)一四項(xiàng)原則;在制度構(gòu)建方面提出以少年司法制度為依托、加強(qiáng)經(jīng)費(fèi)保障、建立合理的教育內(nèi)容體系;在教育方式方法方面提出在教育過(guò)程中綜合采用集體教育法、分類教育法和個(gè)別教育法;在教育主體方面提出要發(fā)揮專門(mén)部門(mén)、學(xué)校、社會(huì)和家庭的教育合力;在對(duì)社區(qū)矯正中的未成年人思想政治教育評(píng)估方面提出要對(duì)教育者、教育過(guò)程和受教育者三個(gè)方面進(jìn)行評(píng)估。
[Abstract]:In modern society, juvenile delinquency has become a global problem. According to relevant data, in recent years, the number of juvenile delinquency has been increasing year by year. How to fully mobilize the positive factors of society and seek the most effective methods to prevent and reduce juvenile delinquency on the basis of the principle of education and punishment as auxiliary has become the urgent task of juvenile criminal justice activities. The multiplicity, multi-level and particularity of the crime reasons make it necessary to adopt a more scientific and humanized way to correct the juvenile delinquency. Community correction is a widely used correction method in the world. Putting juvenile offenders in the community for correction and carrying out ideological and political education in the environment of community correction has become the trend of minor offenders correction education. In this paper, the ideological and political education of minors in community correction is defined as: minor offenders who commit minor crimes in the community, integrate social, family, school and other educational resources. Educational activities to correct their criminal psychology and bad behavior and to help their growth. Its characteristic is the premise is in the community correction environment, the target is the minor criminal who has the lighter crime, the nature is part of three aspects of the penalty execution system. Then it introduces the current situation of ideological and political education of juvenile offenders in the pilot area of community correction in China, summarizes the successful experiences and beneficial practices, points out the existing problems and the reasons for these problems. Then it analyzes the experience and practice of advanced countries. The author puts forward his own conception on the realistic choice of ideological and political education for minors in community correction in our country. In the guiding ideology, the author puts forward the combination of education and punishment in the guiding principle, which is guided by the scientific concept of development. The special departments cooperate with the social resources, the school education and the family education coordinate, the ideological education and the skill education unify four principles; In the aspect of system construction, it is proposed to strengthen the fund guarantee and establish a reasonable educational content system based on the juvenile justice system. In the aspect of educational methods and methods, the author proposes to adopt the collective education law, the classified education law and the individual education law comprehensively in the process of education, and to bring into play the educational joint forces of the special departments, schools, society and families in the aspect of the main body of education; In the aspect of evaluating the ideological and political education of the minors in community correction, it is proposed to evaluate the educator, the educational process and the educatee.
