論我國司法鑒定啟動程序的適用與完善

【摘要】：司法鑒定啟動程序是鑒定制度上的一個基本問題,它是司法鑒定的起始一環(huán),也是關(guān)鍵一環(huán),對此進行深入細致地研究,有助于消除概念上的分歧,把握司法鑒定權(quán)的真實內(nèi)容,統(tǒng)一司法鑒定實踐,同時對于司法鑒定的立法以及訴訟當(dāng)事人的權(quán)利保護均大有裨益。從我國目前情況來看,我國有關(guān)司法鑒定啟動程序方面的立法較為簡單,立法層次較低,立法中仍舊存在著不少空白。立法的不完善必然導(dǎo)致司法實踐中出現(xiàn)諸多矛盾與問題:司法鑒定程序缺少透明度,鑒定當(dāng)事人的權(quán)利得不到保障,多頭鑒定、重復(fù)鑒定頻繁發(fā)生�？梢哉f目前我國司法鑒定領(lǐng)域出現(xiàn)的諸多問題及其爭議,與司法鑒定程序尤其是啟動程序的不完備有著非常密切的聯(lián)系。因此,規(guī)范司法鑒定啟動程序規(guī)則對于確保我國司法鑒定活動的健康發(fā)展有著舉足輕重的意義。
[Abstract]:The initiation procedure of judicial identification is a basic problem in the appraisal system. It is the beginning and the key link of the judicial identification. To study it in depth and meticulous will help to eliminate the conceptual differences. Grasping the true content of the right of judicial expertise and unifying the practice of judicial expertise are of great benefit to the legislation of judicial expertise and the protection of the rights of litigants. From the current situation of our country, the legislation on the initiation procedure of judicial identification in our country is relatively simple, the legislative level is relatively low, and there are still many gaps in the legislation. The imperfect legislation will inevitably lead to many contradictions and problems in judicial practice: the lack of transparency in the judicial identification procedure, the lack of protection of the rights of the parties involved in the appraisal, the frequent occurrence of multiple identification and repeated identification. It can be said that there are many problems and disputes in the field of forensic expertise in our country at present, which are closely related to the incompleteness of judicial identification procedure, especially the initiation procedure. Therefore, it is of great significance to standardize the procedural rules for the initiation of forensic expertise in order to ensure the healthy development of judicial expertise activities in China.
