【摘要】： 警察職業(yè)是一門特殊的職業(yè)，不管是治安管理還是刑事執(zhí)法，警察職業(yè)最基本的特征是代表國(guó)家執(zhí)行行政權(quán)力，是執(zhí)法者。執(zhí)法是警察職業(yè)最核心的內(nèi)容，具有執(zhí)法權(quán)力是警察職業(yè)的本質(zhì)特征。警察職業(yè)道德作為體現(xiàn)著警察職業(yè)特征、表達(dá)著警察職業(yè)責(zé)任和職業(yè)義務(wù)要求的價(jià)值系統(tǒng)，也就與執(zhí)法權(quán)力緊密聯(lián)系，是以行使執(zhí)法權(quán)力的道德要求為其核心內(nèi)容的，因此，警察職業(yè)道德本質(zhì)上是一種執(zhí)法權(quán)力道德。 隨著我國(guó)市場(chǎng)經(jīng)濟(jì)的發(fā)展和我國(guó)加入WTO組織，引發(fā)了社會(huì)全方位的震動(dòng)與變化，公安工作也面臨著許多的新情況和新問題。警察職能重心轉(zhuǎn)移，警察理念的變化等等，時(shí)代的發(fā)展特別是對(duì)警察職業(yè)道德提出了更高、更新的要求。在現(xiàn)實(shí)生活中，警察職業(yè)道德現(xiàn)狀的主流是好的，在維護(hù)國(guó)家政治穩(wěn)定、保護(hù)國(guó)家財(cái)產(chǎn)和人民群眾生命安全、維護(hù)社會(huì)治安方面作出了突出的貢獻(xiàn)，但警察隊(duì)伍中也確實(shí)存在一些問題，如官僚主義傾向；拜金主義思想；人權(quán)意識(shí)淡薄；濫用自由裁量權(quán)，辦關(guān)系案、人情案；警容風(fēng)紀(jì)不整，不文明執(zhí)勤等等，這些問題的存在有其經(jīng)濟(jì)、政治、文化等社會(huì)原因。概括起來(lái)主要有：市場(chǎng)經(jīng)濟(jì)的缺陷對(duì)警察職業(yè)道德的沖擊；長(zhǎng)期以來(lái)形成的人治環(huán)境的影響；傳統(tǒng)倫理關(guān)系道德對(duì)警察隊(duì)伍的負(fù)面效應(yīng)；警察隊(duì)伍面臨更為復(fù)雜的善惡矛盾和價(jià)值沖突；警察制度不完善對(duì)警察職業(yè)道德建設(shè)產(chǎn)生的負(fù)面導(dǎo)向等等。 警察作為國(guó)家意志的執(zhí)行者和人民“公共利益”的維護(hù)者，他們的職業(yè)道德同其他行業(yè)的職業(yè)道德相比有著自己的特殊地位和作用。在市場(chǎng)經(jīng)濟(jì)條件下進(jìn)一步加強(qiáng)我國(guó)警察職業(yè)道德建設(shè)具有重要價(jià)值。有利于警察樹立起良好的執(zhí)法形象；有利于維護(hù)黨和國(guó)家在人民群眾中的威望；有利于實(shí)現(xiàn)執(zhí)法公正；有利于提高執(zhí)法效率；有利于社會(huì)主義精神文明建設(shè)的健康發(fā)展；有利于實(shí)現(xiàn)警察自身的逐漸完善和全面發(fā)展等等。 在市場(chǎng)經(jīng)濟(jì)條件下加強(qiáng)警察職業(yè)道德建設(shè)，我們要進(jìn)一步完善警察職業(yè)道 ⑧蕊 位論文 5 TllESIS 德規(guī)范體系，使之進(jìn)一步制度化;加強(qiáng)警察的職業(yè)道德教育和自我道德修養(yǎng)， 為提升警察的職業(yè)道德水平提供合理正當(dāng)公正的制度安排;加強(qiáng)對(duì)警察職業(yè)道 德行為的監(jiān)督;加強(qiáng)對(duì)警察職業(yè)道德的法律建構(gòu)等等，，總之，要把他律和自律 結(jié)合起來(lái)，把倫理制度化和制度倫理化結(jié)合起來(lái)，在實(shí)踐操作中，依靠全社會(huì) 的力量，形成全社會(huì)的合力來(lái)加強(qiáng)警察的職業(yè)道德建設(shè)，從而使人民警察真正 做到“立警為公，執(zhí)法為民”。
[Abstract]:The police profession is a special profession, whether it is public order management or criminal law enforcement, the most basic characteristic of the police profession is to execute the administrative power on behalf of the state, and to be the law enforcer. Law enforcement is the core content of the police profession, and law enforcement power is the essential feature of the police profession. Police professional ethics, as a value system that embodies the professional characteristics of police and expresses the demands of professional responsibility and duty of police, is closely related to law enforcement power and takes the moral requirements of law enforcement power as its core content. Police professional ethics is essentially a kind of law enforcement power morality. With the development of China's market economy and China's entry into WTO, the whole society is shaking and changing, and the public security work is faced with many new situations and problems. With the shift of police function, the change of police concept and so on, the development of the times puts forward higher and newer requirements for police professional ethics. In real life, the mainstream of police professional ethics is good, and has made outstanding contributions in maintaining national political stability, protecting state property and the safety of the people's lives, and maintaining social security. However, there are also some problems in the police force, such as bureaucratic tendencies; money worship ideology; weak awareness of human rights; abuse of discretion, handling of relations cases, human relations cases; disorderly conduct of the police and conduct of duties in an uncivilized manner; and so on. The existence of these problems has its economic, political, cultural and other social reasons. Generally speaking, it includes: the impact of market economy defects on police professional ethics, the influence of the human rule environment formed for a long time, the negative effect of traditional ethics and morality on the police force; The police force is faced with more complex conflicts of good and evil and value conflicts; the imperfect police system leads to the construction of police professional ethics and so on. As the executor of the national will and the defender of the people's "public interest", the police's professional ethics has its own special status and function compared with the professional ethics of other professions. It is of great value to further strengthen the construction of police professional ethics in the market economy. It is beneficial for the police to set up a good image of law enforcement, to maintain the prestige of the party and the state among the people, to realize the justice of law enforcement, to improve the efficiency of law enforcement, to promote the healthy development of the socialist spiritual civilization, and to improve the efficiency of law enforcement. It is conducive to the gradual improvement and overall development of the police itself.
