【摘要】：隨著經(jīng)濟的飛速發(fā)展,受賄犯罪也愈演愈烈。這不僅發(fā)生在公務(wù)部門,同時也蔓延到非公務(wù)部門,農(nóng)信社就是其適例。本文從犯罪學(xué)的角度首先分析了農(nóng)信社人員受賄的特征,其特征與其他部門的受賄犯罪既具有共性也具有個性,其主要特征是犯罪主體呈多元化,并且具有“平民化”的趨勢、受賄行為行業(yè)特點明顯并且發(fā)案部位集中化等等。其次分析了農(nóng)信社人員受賄犯罪的成因,從文化角度看是由于傳統(tǒng)文化中的禮制文化、官本位文化和宗法倫理和西方文化中拜金主義和享樂主義共同影響下造成的；從經(jīng)濟角度看是由于經(jīng)濟轉(zhuǎn)型的弊端和分化中的偏差導(dǎo)致的；從制度角度看是由于農(nóng)信社不完善的法人治理結(jié)構(gòu)、內(nèi)部人控制和缺乏健全的監(jiān)督機制造成的；從個體角度看是由于農(nóng)信社人員的個體需要的膨脹再加上從眾心理、失衡心理和僥幸心理所導(dǎo)致的。最后在原因的基礎(chǔ)上對農(nóng)信社人員受賄提出了相關(guān)對策,首要的是進行道德預(yù)防,就是要弱化傳統(tǒng)文化中的糟粕,加強廉政文化的建設(shè)并且對農(nóng)信社人員進行思想教育；而后是進行制度預(yù)防,從宏觀上要構(gòu)建具有預(yù)防受賄犯罪的市場經(jīng)濟制度和民主政治制度,從微觀上要改革農(nóng)信社的外部和內(nèi)部治理結(jié)構(gòu)并且完善稽核監(jiān)察制度；最后是進行法律預(yù)防,對受賄犯罪的構(gòu)成要件進行完善。
[Abstract]:With the rapid development of economy, bribery crime is becoming more and more serious. This occurs not only in the civil service, but also in the non-public sector. From the angle of criminology, this paper first analyzes the characteristics of accepting bribes of rural credit cooperatives personnel. The characteristics have both commonness and individuality with the bribery crimes of other departments, the main characteristics of which are that the subject of the crime is diversified and has the trend of "populace". The characteristics of bribery industry are obvious and the location of the crime is centralized and so on. Secondly, it analyzes the causes of the crime of accepting bribes by the personnel of the rural credit cooperatives. From the cultural point of view, it is caused by the common influence of the traditional culture, the official culture and patriarchal ethics, as well as the money worship and hedonism in the western culture. From the economic point of view, it is caused by the malpractice of the economic transformation and the deviation in the differentiation, the imperfect corporate governance structure of the rural credit cooperatives, the internal control and the lack of sound supervision mechanism. From the individual point of view, it is caused by the expansion of the individual needs of the RCCs, as well as the psychology of conformity, imbalance and luck. Finally, on the basis of the reasons, the paper puts forward the relevant countermeasures to the bribery of rural credit cooperative personnel, the first is to carry on the moral prevention, is to weaken the dross in the traditional culture, to strengthen the construction of the clean government culture and to carry on the ideological education to the rural credit cooperative personnel; Secondly, it is necessary to carry on the system prevention, to construct the market economy system and the democratic political system with the crime of bribery prevention from the macroscopic view, to reform the external and internal governance structure of the rural credit cooperative from the microscopic point of view, and to perfect the audit and supervision system; Finally, it is to carry on the legal prevention, carries on the consummation to the bribery crime constituent element.
