【摘要】：激情犯罪是一種在特定情境的刺激下而瞬間爆發(fā)的強(qiáng)烈的情緒型犯罪,具有強(qiáng)烈的擴(kuò)散性和破壞性,沒有可預(yù)見性,因此對社會的危害極大。激情犯罪是情緒犯罪的一種形式,我國的女性激情犯罪率呈明顯的上升趨勢,危害越來越大,已經(jīng)成為一個(gè)嚴(yán)重的社會問題�，F(xiàn)代犯罪生物學(xué)理論認(rèn)為,無論哪種犯罪,從最輕微的到最殘忍的,都不外乎是犯罪者的生理狀態(tài)、其所處的自然條件和其出生、生活、或工作于其中的社會環(huán)境三種因素相互作用的結(jié)果。客觀而系統(tǒng)的觀察已經(jīng)表明,盡管社會環(huán)境的影響存在于多數(shù)案件,但是,僅此一種原因,尚不足以解釋為犯罪的起因。只有用這三種因素的影響,才能解釋犯罪行為。當(dāng)然,生理學(xué)、自然及社會三方面因素的影響大小,在每一個(gè)案件中各不相同。在一些盜竊案件中,社會因素的影響遠(yuǎn)比生理學(xué)因素的影響要大。但在殺害案件中,生理學(xué)因素的影響則比社會因素的影響要大得多。在我國對女性激情犯罪原因的研究中,更多的是偏向社會學(xué)、經(jīng)濟(jì)學(xué)原因的探討,而本文則是運(yùn)用了個(gè)案研究法、觀察法、定性分析法等等,著重從影響女性激情犯罪的生理學(xué)因素角度剖析其原因,一方面是女性特殊生理期內(nèi)體內(nèi)激素水平的變化導(dǎo)致激素對垂體的抑制減弱,于是出現(xiàn)繼發(fā)性垂體功能亢進(jìn),引起神經(jīng)-心理、神經(jīng)-內(nèi)分泌-心理、神經(jīng)-免疫-心理等系統(tǒng)調(diào)節(jié)紊亂,從而引起的一系列的焦慮、憂郁、緊張、多疑、恐懼、易激動、敏感、憤怒、悲觀等情志障礙,在外界誘因的刺激下進(jìn)而引發(fā)激情犯罪行為；另一方而是女性體內(nèi)礦物質(zhì)鈣鎂的缺乏同樣引起的焦慮、煩躁、暴怒等引發(fā)的激情犯罪行為。最后針對性地提了一點(diǎn)預(yù)防女性激情犯罪行為的拙略,以期在預(yù)防和減少女性激情犯罪方而有一定的意義。
[Abstract]:The crime of passion is a kind of strong emotional crime that erupts in a moment under the stimulation of a specific situation. It has strong diffusivity and destruction and is not predictable, so it does great harm to the society. The crime of passion is a form of emotional crime. The crime rate of female passion in our country is rising obviously, and the harm is more and more serious, which has become a serious social problem. Modern criminal biology theory holds that whatever kind of crime, from the smallest to the most cruel, is nothing more than the physiological state of the offender, the natural conditions in which he is located and his birth and life. Or the social environment in which the three factors interact. Objective and systematic observations have shown that, although the influence of the social environment exists in most cases, this alone is not enough to explain the cause of the crime. Only by the influence of these three factors can criminal behavior be explained. Of course, the effects of physiological, natural and social factors vary from case to case. In some theft cases, social factors have a greater impact than physiological ones. In killing cases, however, physiological factors have a much greater effect than social factors. In the study of the causes of female passion crime in China, there is a tendency to probe into the causes of sociology and economics. In this paper, case study, observation, qualitative analysis and so on are used. From the point of view of physiological factors affecting female crime of passion, on the one hand, the changes of hormone level in women's body during the special physiological period lead to the weakening of hormone inhibition on pituitary gland, and then secondary hyperfunction of pituitary gland appears. Causing disorders in neuro-psychological, neuro-endocrine, neuro-psychological, neuro-immuno-psychological, and so on, resulting in a series of anxiety, depression, tension, paranoia, fear, agitation, sensitivity, anger, pessimism and other emotional disorders, On the other hand, the lack of calcium and magnesium in the female body caused the same anxiety, irritability, rage and so on. Finally, the author puts forward some strategies to prevent the crime of female passion, in order to prevent and reduce the crime of female passion.
