我國公安文職制度研究

【摘要】: 隨著中國經(jīng)濟的飛速發(fā)展,治安形勢日趨嚴峻,公安機關警力不足的問題在各地普遍存在并日益嚴重,與公安工作要求和社會總體需求形成了突出矛盾。同時,在國家機關精簡機構(gòu)、強調(diào)效率及效益的前提下,警力數(shù)量的增加非常有限,現(xiàn)有的以公務員性質(zhì)為主的警力資源結(jié)構(gòu)越來越顯現(xiàn)出不相適應的一面。只有通過對警力的合理配置,推動警察人力資源結(jié)構(gòu)優(yōu)化,降低國家使用警察的經(jīng)濟成本,才能解決現(xiàn)有警力的結(jié)構(gòu)性失調(diào)問題,加快警察隊伍的職業(yè)化、專業(yè)化和正規(guī)化建設,更好地履行公安職能。 本文在回顧國內(nèi)外公安文職制度研究現(xiàn)狀的基礎上,總結(jié)公安文職制度的實施經(jīng)驗,特別是現(xiàn)行公安文職制度的基本模式、主要特點及推行范圍,分析了我國公安文職制度實施中存在的主要問題,并且提出了相應的完善方案。論文共分七章。 第一章緒論,從當前國內(nèi)公安機關警力配置情況和社會需求入手,引出全文的研究意義;介紹了國內(nèi)外公安文職制度的研究現(xiàn)狀、論文的研究內(nèi)容和研究方法。 第二章闡述了公安文職制度的內(nèi)涵,并通過公安文職人員與警察、聘任制公務員、輔助警力的比較,指出了建立公安文職制度的理論基礎和現(xiàn)實原因。 第三章介紹了國內(nèi)部分地區(qū)試行公安文職制度的情況,總結(jié)了現(xiàn)有制度的基本模式、主要特點、推行范圍,剖析了在實施公安文職制度中存在的主要問題,例如:法律地位難以準確界定、崗位設置缺乏科學依據(jù)、特殊民警退出機制不全造成轉(zhuǎn)崗難等。 第四章介紹了英、美、法等發(fā)達國家的公安文職制度,分析了國外經(jīng)驗對我國的借鑒意義。 第五章在借鑒國外經(jīng)驗的基礎上,針對存在的問題提出了相應的對策建議,即從建立健全公安文職制度的相關法律和制度、采用科學的文職人員管理模式、建立文職人員的專門序列等方面予以完善和改進。 第六章為案例分析,分析了上海市公安局浦東分局實施公安文職制度的基本情況、取得的成效,存在的問題及可采取的措施,從而為本文的觀點提供實踐依據(jù)。 第七章結(jié)束語,對論文總體情況進行了回顧,歸納了主要的研究結(jié)論,指出論文的不足之處及改進的方向。
[Abstract]:With the rapid development of China's economy, the public security situation is becoming more and more serious, and the problem of insufficient police force in public security organs is widespread and increasingly serious in various places, which has formed a prominent contradiction with the requirements of public security work and the overall needs of the society. At the same time, under the premise of streamlining the structure of state organs and emphasizing efficiency and effectiveness, the increase in the number of police force is very limited, and the existing police resource structure, which is based on the nature of civil servants, is becoming more and more inadaptable. Only through the rational allocation of police force, promoting the optimization of police human resource structure and reducing the economic cost of using the police can we solve the problem of structural imbalance of the existing police force and speed up the professionalization of the police force. On the basis of reviewing the present research situation of the public security civilian system at home and abroad, this paper summarizes the experience of the implementation of the public security civilian system, especially the basic mode, main characteristics and implementation scope of the current public security civilian system. This paper analyzes the main problems existing in the implementation of the public security civilian system in our country, and puts forward the corresponding consummation scheme. The paper is divided into seven chapters. The first chapter is introduction, starting with the present situation of the police force allocation and social demand of the public security organs in China, the research significance of the full text is drawn, and the present research situation, the research content and the research methods of the public security civilian system at home and abroad are introduced. The second chapter expounds the connotation of the public security civilian system, and points out the theoretical basis and practical reasons for the establishment of the public security civilian system through the comparison between the public security civilian personnel and the police, the appointment system of civil servants and the auxiliary police force. The third chapter introduces the trial of the public security civilian system in some parts of the country, summarizes the basic mode, main characteristics, implementation scope of the existing system, and analyzes the main problems existing in the implementation of the public security civilian system. For example: the legal status is difficult to define accurately, the post establishment lacks the scientific basis, the special police exit mechanism does not completely cause the shift post difficulty and so on. Chapter four introduces the public security civilian system in developed countries, such as Britain, America and France, and analyzes the significance of foreign experience to our country. Based on the experience of foreign countries, the fifth chapter puts forward the corresponding countermeasures and suggestions, that is, to establish and perfect the relevant laws and systems of the public security civilian system, and to adopt the scientific management mode of civilian personnel.
